Prórroga de la investigación preparatoria en delitos comunes y el derecho al plazo razonable, distrito fiscal de San Martín-Tarapoto, 2019

Abstract

El objetivo general de la investigación es el determinar de qué manera la prórroga de la investigación preparatoria en los delitos comunes repercute en el derecho al plazo razonable, en el Distrito Fiscal de San Martín-Tarapoto, 2019. Las bases teóricas se centran tanto en la investigación preparatoria y el derecho al plazo razonable. La investigación fue de enfoque cuantitativo y diseño fue transeccional y correlacional, la muestra de trabajo de campo estuvo conformada por 157 carpetas fiscales por delitos comunes contra la vida el cuerpo y la salud, contra el patrimonio y contra la libertad sexual tramitadas en la segunda fiscalía provincial penal corporativa de San Martin-Tarapoto durante el periodo 2019, la técnica aplicada en el acopio de datos fue el cuestionario de expertos y el instrumento fue validado por 5 especialistas. La conclusión es que se comprueba que la prórroga de la investigación preparatoria en los delitos comunes repercute de manera negativa en el derecho al plazo razonable, en el Distrito Fiscal de San Martín-Tarapoto, 2019; ya que lo vulnera al no realizar las diligencias establecidas en el plazo ordinario de manera justificada.

The general objective of the investigation is to determine how the extension of the preparatory investigation in common crimes affects the right to a reasonable time, in the San Martín-Tarapoto Fiscal District, 2019. The theoretical bases focus so much on the preparatory investigation and the right to reasonable time. The investigation was of a quantitative approach and the design was transectional and correlational, the field work sample was made up of 157 fiscal folders for common crimes against life, body and health, against property and against sexual freedom processed in the second prosecutor's office San Martin-Tarapoto corporate penal province during the 2019 period, the technique applied in data collection was the expert questionnaire and the instrument was validated by 5 specialists. The conclusion is that it is verified that the extension of the preparatory investigation in common crimes has a negative impact on the right to a reasonable time, in the San Martín-Tarapoto Fiscal District, 2019; since it violates it by not carrying out the procedures established in the ordinary term in a justified manner.
