Vulneración del principio de igualdad por la aplicación o inaplicación de la responsabilidad restringida, Iquitos 2019 - 2021

Abstract

La presente investigación tuvo como objetivo general determinar si la aplicación e inaplicación de la responsabilidad restringida por la edad, afecta el principio constitucional de igualdad ante la ley; enfocándose en el análisis documental de sentencias casatorias o de recursos de nulidad que han ido estableciendo parámetros a favor de que la normativa del segundo párrafo del Art. 22 del Código Penal trasgrede el principio constitucional de Igualdad ante la Ley, para lo cual se ha desarrollado una investigación de tipo Básica, con un enfoque cualitativo, el Diseño fue no experimental y transversal, método dogmático, habiéndose concluido que la aplicación e inaplicación de la responsabilidad restringida por la edad, prevista en el Artículo 22 del Código Penal, si afecta el principio constitucional de igualdad ante la ley, confirmándose de esa manera la hipótesis general planteada y las hipótesis específicas.

The present investigation had as general objective to determine if the application and non-application of the responsibility restricted by age, affects the constitutional principle of equality before the law; focusing on the documentary analysis of cassation sentences or nullity appeals that have been establishing parameters in favor of the regulations of the second paragraph of Art. 22 of the Penal Code transgressing the constitutional principle of Equality before the Law, for which it has been developed a Basic type investigation, with a qualitative approach, the Design was nonexperimental and transversal, dogmatic method, having concluded that the application and non-application of the responsibility restricted by age, provided for in Article 22 of the Penal Code, if it affects the principle equality before the law, thus confirming the general hypothesis raised and the specific hypotheses.
