El Incumplimiento del Régimen de Visitas con Sentencia en el Juzgado de Familia en la Ciudad de Iquitos en el Año 2022

Abstract

En presente investigación el objetivo era “Determinar el perjuicio y vulneración de sus derechos que se ocasionan al niño o niña y adolescente por el incumplimiento del régimen de visitas en el juzgado de familia en la ciudad de Iquitos en el año 2022”, Nuestra Constitución Política, manifiesta que la familia es la célula básica de la sociedad, su formación o conformación a través del matrimonio o las uniones de hecho, dan origen a la prole, es decir, al crecimiento de la familia a través de los hijos. En esta investigación se usó la metodología descriptiva, debido a que se va a describir la problemática respecto ¿De qué manera se vulnera el interés superior del niño por causa del incumplimiento del régimen de visitas?, para eso tomamos como muestra 66 personas entre hombres y mujeres con demandas sobre régimen de visitas, se usó la técnica de la encuesta a través de un cuestionario de 11 preguntas, donde queríamos saber si hubo afectación al interés superior del niño, al progenitor y cuáles eran las sanciones sobre el incumplimiento del régimen de visitas. Como conclusión general se pudo determinar que si hubo afectación al interés del niño, niña y adolescentes pero que no existe legislación que sancione dicho incumplimiento.

In this investigation, the objective was to "Determine the damage and violation of their rights that are caused to the boy or girl and adolescent due to non-compliance with the visitation regime in the family court in the city of Iquitos in the year 2022", Our Political Constitution, states that the family is the basic cell of society, its formation or conformation through marriage or common-law unions, give rise to offspring, that is, the growth of the family through children. In this investigation, the descriptive methodology was used, because the problem is going to be described regarding: In what way is the best interest of the child violated due to non-compliance with the visitation regime?, for that we took as a sample 66 people between men and women with demands on the visitation regime, the survey technique was used through a questionnaire of 11 questions, where we wanted to know if there was an impact on the best interest of the child, the parent and what were the sanctions for non-compliance with the visitation regime . As a general conclusion, it was possible to determine that the interest of the child and adolescents was affected, but that there is no legislation that sanctions said non-compliance.
