Abstract
La presente investigación partió del problema ¿La exigibilidad de la prueba
escrita en los medios probatorios resulta ser difícil para el reconocimiento
judicial de una unión de hecho, debido al excesivo estándar probatorio para
acreditar el estado de convivientes de una pareja?, teniendo como objetivo
principal: Determinar si la exigibilidad de la prueba escrita en los medios
probatorios resulta ser difícil para el reconocimiento judicial de una unión de
hecho, debido al excesivo estándar probatorio para acreditar el estado de
convivientes de una pareja. La técnica que se empleó fue la encuesta y el
instrumento fue el cuestionario. La población estuvo conformada por los
Abogados Litigantes del Colegio de Abogados de Loreto, la muestra estuvo
conformada por 40 abogados del Colegio de Abogados de Loreto. El diseño
que se empleó en la presente investigación es la “No experimental de tipo
transaccional o transversal de nivel descriptivo”. Para el análisis estadístico se
usó la estadística descriptiva, para el estudio de las variables de manera
independiente y para demostración de las hipótesis se usó la prueba
paramétrica chi cuadrado (x2). Los resultados indicaron que: La exigibilidad de
la prueba escrita en los medios probatorios sí resulta ser difícil para el
reconocimiento judicial de una unión de hecho. Por lo que, se plantea modificar
el segundo párrafo del artículo 326 del Código Civil eliminando la expresión
“siempre que exista un principio de prueba escrita” para el reconocimiento
judicial de una unión de hecho en los procesos de Unión de hecho.
The present research was based on the problem: Is the enforceability of the written evidence in the evidentiary means difficult for the judicial recognition of a common-law marriage, due to the excessive evidentiary standard to prove the status of cohabitants of a couple? The main objective of this research was: To determine if the enforceability of the written evidence in the evidentiary means is difficult for the judicial recognition of a common-law marriage, due to the excessive evidentiary standard to prove the status of cohabitants of a couple. The technique used was the survey and the instrument was the questionnaire. The population consisted of the trial lawyers of the Loreto Bar Association, and the sample consisted of 40 lawyers of the Loreto Bar Association. The design used in this research is the "non-experimental transactional or transversal type of descriptive level". For the statistical analysis, descriptive statistics were used to study the variables independently and to demonstrate the hypotheses, the parametric chi-square test (x2) was used. The results indicated that: The requirement of written evidence in the means of proof does prove to be difficult for the judicial recognition of a common-law marriage. Therefore, it is proposed to modify the second paragraph of article 326 of the Civil Code by eliminating the expression "provided that there is a principle of written proof" for the judicial recognition of a de facto union in de facto union proceedings.
