Abstract
El objetivo principal de la tesis de investigación es la de Analizar si la
implementación de la oralidad en el proceso civil peruano vulnera la garantía
del proceso establecido por ley regulado en la Constitución Política del Perú,
específicamente en el artículo 139, inciso 3, párrafo 2. En cuanto a nuestra
metodología, la presente tesis es de tipo cuantitativa, con nivel descriptivo y
diseño no experimental de tipo transversal. Nuestra población está conformada
por los abogados del Colegio de Abogados de Loreto y nuestra muestra por 90
abogados litigantes del Colegio de Abogados de Loreto. La técnica e instrumento
que empleamos para el desarrollo del trabajo fue la encuesta y el cuestionario
respectivamente. En cuanto al análisis estadístico se empleó la prueba de chi
cuadrado, la cual es una prueba no paramétrica que se emplea en el estudio de
las variables de manera independiente y para demostrar las hipótesis
planteadas. Tras analizar la información recabada mediante el cuestionario se
llegó a la conclusión que la implementación de la oralidad en el proceso civil
peruano sí vulnera la garantía del proceso establecido por ley, ya que la
implementación que se viene realizando debería legitimarse mediante un decreto
Ley y no por una Resolución administrativa.
The main objective of the research thesis is to analyze whether the implementation of oral proceedings in the Peruvian civil process violates the guarantee of due process established by law regulated in the Political Constitution of Peru, specifically in Article 139, paragraph 3, paragraph 2. As for our methodology, this thesis is quantitative, with descriptive level and nonexperimental cross-sectional design. Our population is made up of lawyers from the Loreto Bar Association and our sample is made up of 90 trial lawyers from the Loreto Bar Association. The technique and instrument we used for the development of the work was the survey and the questionnaire respectively. As for the statistical analysis, we used the chi-square test, which is a non- parametric test used in the study of variables independently and to demonstrate the hypotheses proposed. After analyzing the information gathered through the questionnaire, it was concluded that the implementation of orality in the Peruvian civil process does violate the guarantee of the process established by law, since the implementation that is being carried out should be legitimized by a Decree Law and not by an administrative Resolution.
