El trabajo de investigación tuvo como objetivo determinar si los Juzgados Penales de Maynas, en el periodo 2018 – 2020, aplicaron la inobservancia del plazo razonable de la investigación como circunstancia atenuante en la determinación de la pena.
La población estuvo conformada por los Fiscalías Penales de Loreto y por los Jueces Penales de la Corte Superior de Justicia de Loreto, siendo la muestra analizada 15 requerimientos fiscales acusatorios y 15 sentencias condenatorias, correspondientes a procesos penales tramitados en la provincia de Maynas durante el periodo 2018 – 2020. Así también se realizó encuestas a 15 magistrados de cada institución, como a 15 abogados del Distrito Fiscal de Loreto.
Las técnicas empleadas en la recolección de los datos fueron la documental, mediante la cual se recabó información de los requerimientos fiscales acusatorios y sentencias condenatorias, siendo el instrumento utilizado la ficha de registro; también las encuestas formuladas a magistrados de la Corte Superior de Justicia de Loreto y del Distrito Fiscal de Loreto, como a abogados del Distrito Judicial de Loreto, consistiendo el instrumento utilizado el cuestionario previamente estructurado.
Para el procesamiento de datos se aplicó la estadística descriptiva con análisis de frecuencia promedio y porcentaje, las mismas que serán expuestas en tablas y gráficos estadísticos.
The objective of the investigation work was to determine whether
the Criminal Courts of Maynas, in the period 2018-2020, applied the nonobservance of the reasonable period of time of the investigation as a
mitigating circumstance in the determination of the sentence.
The population was made up of the Loreto Criminal Prosecutor's
Offices and the Criminal Judges of the Loreto Superior Court of Justice, with
the analyzed sample being 15 accusatory prosecutorial requests and 15
convictions, corresponding to criminal proceedings processed in the
province of Maynas during the period. 2018 - 2020. In addition, surveys
were conducted with 15 magistrates from each institution, as well as 15
lawyers from the Loreto Fiscal District.
The techniques used in data collection were documentary, through
which information was collected on prosecutorial requirements and
convictions, the instrument used being the registration form; Also the
surveys made to magistrates of the Superior Court of Justice of Loreto and
of the Loreto Fiscal District, as well as to lawyers of the Judicial District of
Loreto, the instrument used consisting of the previously structured
questionnaire.
For data processing, descriptive statistics were applied with
analysis of average frequency and percentage, which will be shown in
statistical tables and graphs.
