Abstract
El presente trabajo de investigación titulado “El cumplimiento del debido proceso en los procedimientos administrativos disciplinarios en la Municipalidad Provincial de Maynas, periodo del 2018 al 2020”, viene a constituir una investigación: Aplicada, cuyo proposición será determinar si en nuestro actual sistema administrativo se cumple a cabalidad el debido proceso como principio básico para una justicia administrativa, partiendo de los casos administrativos llevados a cabo en la Municipalidad Provincial de Maynas, con los fines que son compatibles con el Estado, si existe una adecuada eficacia de justicia del Derecho Administrativo.
El resultado de la presente investigación, nos permite identificar dentro de las variables de causas y efectos que existe falta de sustancialidad, eficacia, y buen diseño en las normas del Derecho administrativo , así como incumplimiento y hasta falta de voluntad en el apego al principio proceso del debido proceso en los casos disciplinarios que se ventilan en la Municipalidad Provincial de Maynas, en los años 2018 al 2020 lo que ocasiona negligencia, desidia, demora, burocracia, y por lo tanto ineficacia de sus fines. Ante ésta situación se plantea alternativas de solución que podrán implementarse de forma efectiva para mejorar el problema.
The present research work entitled "Compliance with due process in disciplinary administrative procedures in the Provincial Municipality of Maynas, period from 2018 to 2020", constitutes an investigation: Applied, whose propositions will be to determine if in our current administrative system It fully complies with due process as a basic principle for administrative justice, based on the administrative cases carried out in the Provincial Municipality of Maynas, with purposes that are compatible with the State, if there is an adequate justice effectiveness of Administrative Law. The result of this investigation allows us to identify within the variables of causes and effects that there is a lack of substantiality, effectiveness, and good design in the rules of administrative law, as well as non-compliance and even lack of will in adherence to the process principle. of due process in disciplinary cases that are aired in the Provincial Municipality of Maynas, in the years 2018 to 2020, which causes negligence, apathy, delay, bureaucracy, and therefore ineffectiveness of its purposes. Faced with this situation, alternative solutions are proposed that can be implemented effectively to improve the problem.
