Inconstitucionalidad de la ley de derecho de autor y protección del derecho a la creación intelectual en docentes universitarios 2020

Abstract

La presente investigación partió del problema ¿De qué manera la reprografía de obras, vulnera el derecho constitucional del autor con relación a la propiedad intelectual y al beneficio económico del autor en la Universidad Científica del Perú? Y el objetivo fue: Explicar de qué manera la reprografía de obras, vulnera el derecho constitucional del autor con relación a la propiedad intelectual y al beneficio económico del autor en la Universidad Científica del Perú. La técnica que se empleó fue la encuesta y el instrumento fue el cuestionario. La población estuvo conformada por 222 docentes de la Universidad Científica del Perú. El diseño que se empleo fue el no experimental de tipo transaccional correlacional. Para el análisis estadístico se usó la estadística descriptiva, para el estudio de las variables en forma independiente y para demostración de las hipótesis se usó la prueba paramétrica chi cuadrado (x2). Los resultados indicaron que: La reprografía de obras vulnera el derecho del autor con relación a su creación intelectual sin recibir contraprestación económica por ello, sumado a ello que no existe marco legal que proteja de manera eficaz los derechos del autor frente a la indiscriminada reproducción en fotocopiado de su creación intelectual.

The present investigation started from the problem: In what way does the reprography of works violate the constitutional right of the author in relation to intellectual property and the economic benefit of the author at the Scientific University of Peru? And the objective was: Explain how the reprography of works violates the constitutional right of the author in relation to intellectual property and the economic benefit of the author at the Scientific University of Peru. The technique used was the survey and the instrument was the questionnaire. The population consisted of 222 teachers from the Scientific University of Peru. The design used was the non-experimental, transactional correlational type. For the statistical analysis, descriptive statistics were used, for the study of the variables independently and for the demonstration of the hypotheses, the parametric chi-square test (x2) was used. The results indicated that: The reprography of works violates the rights of the author in relation to their intellectual creation without receiving economic compensation for it, in addition to that there is no legal framework that effectively protects the rights of the author against indiscriminate reproduction in photocopied of his intellectual creation.
