Abstract
La presente investigación tiene como objetivo: demostrar respecto a las
facultades que posee el Fiscal Superior en el ámbito de sus funciones que la norma procesal penal ha omitido una función muy importante que genera limitaciones en el cumplimiento de su función, facultad que
expresamente le ha sido asignada al Juez de investigación preparatoria,
pese a no constituir parte de sus funciones, disponer la ampliación
suplementaria de la investigación fiscal, empero a diferencia de otras tesis que hemos encontrado como antecedentes, en la presente no nos
oponemos a las funciones asignadas al Juez de investigación preparatoria, creemos que en la etapa intermedia el juez puede advertir la omisión de
actos de investigación por parte del fiscal y de manera excepcional
disponer una ampliación suplementaria donde no reemplaza al fiscal
simplemente ordena la actuación de actos que pueden ser trascendentes para su pronunciamiento, respecto al planteamiento de requerimiento de sobreseimiento por parte del Fiscal Provincial, en este punto estamos convencidos que dicha función- que fortalece la investigación- también
debe otorgarse al Fiscal Superior que al igual que el Juez de Investigación Preparatoria va a pronunciarse en su caso en instancia de apelación y para su pronunciamiento que va a confirmar o rectificar el requerimiento de sobreseimiento formulado por el fiscal provincial, requiere tener estas facultades que además recaen bajo el principio de unidad de función fiscal
y que va a permitir ante el requerimiento de sobreseimiento del Fiscal
Provincial, especialmente en el caso de discrepancia y rectificación del
requerimiento, ordenar una acusación con mayores elementos de
convicción y mayor cimentación en su formulación, lo que facilitará al
mismo tiempo la labor y función del nuevo fiscal provincial convocado a
formular acusación, quien contará con mayores argumentos para su
requerimiento acusatorio, máxime teniendo en cuenta que sin una
acusación sólida no es posible lograr una sentencia condenatoria justa.
The purpose of this investigation is to demonstrate that, with respect to the powers of the Senior Prosecutor within the scope of his functions, the criminal procedural rule has omitted a very important function that generates limitations in the fulfillment of his function, a power that has been expressly assigned to the Judge of preliminary investigation, despite not being part of his functions, to order the supplementary extension of the fiscal investigation. Regarding the request for dismissal by the Provincial Prosecutor, at this point we are convinced that said function - which strengthens the investigation - should also be granted to the Senior Prosecutor who, like the Judge of Preparatory Investigation, will pronounce himself in his case at the appeal stage and for his pronouncement he will To confirm or rectify the request for dismissal made by the provincial prosecutor, it is necessary to have these powers that also fall under the principle of unity of fiscal function and that will allow, in the case of a request for dismissal from the Provincial Prosecutor, especially in the case of discrepancy and rectification of the request, to order an accusation with greater elements of conviction and greater foundation in its formulation, which will facilitate at the same time the work and function of the new provincial prosecutor summoned to formulate the accusation, who will have greater arguments for his accusatory request, especially taking into account that without a solid accusation it is not possible to achieve a fair conviction.
