Abstract
La presente investigación partió del problema si ¿Existe inobservancia al principio de lesividad en la legislación penal cuando se contempla, en los casos de incumplimiento de medidas de protección, una pena menor para el delito de agresiones en contra de mujeres o integrantes del grupo familiar (artículo 122-B del Código Penal), ¿en comparación con el delito de resistencia o desobediencia a la autoridad (artículo 368 del Código Penal)? Y el objetivo fue: Determinar si existe una inobservancia al principio de lesividad en la legislación penal cuando se contempla, en los casos de incumplimiento de medidas de protección, una pena menor para el delito de agresiones en contra de mujeres o integrantes del grupo familiar (artículo 122-B del Código Penal), en comparación con el delito de resistencia o desobediencia a la autoridad (artículo 368 del Código Penal). La técnica que se empleó fue la encuesta y el instrumento fue el cuestionario. La población estuvo conformada por el distrito fiscal de Loreto, la muestra estuvo conformada por 30 fiscales penales entre Provinciales y Adjuntos Provinciales. El diseño que se empleo fue no experimental de tipo transaccional correlacional. Para el análisis estadístico se usó la estadística descriptiva, para el estudio de las variables en forma independiente y para demostración de las hipótesis se usó la prueba paramétrica chi cuadrado (x2). Los resultados indicaron que: Existe una inobservancia al principio de lesividad en la legislación penal cuando se contempla, en los casos de incumplimiento de medidas de protección, una pena menor para el delito de agresiones en contra de mujeres o integrantes del grupo familiar (artículo 122-B del CP), en comparación con el delito de resistencia o desobediencia a la autoridad (artículo 368 del Código Penal), lo cual podría debilitar la prevención y sanción adecuada de los delitos de violencia de género. necesario evaluar la posibilidad de establecer medidas legislativas que permitan garantizar una aplicación proporcional y efectiva, en observancia del principio de lesividad en la tipificación penal del incumplimiento de las medidas de protección.
The present investigation started from the problem if there is non-observance of the principle of harmfulness in criminal legislation when it contemplates, in cases of non-compliance with protection measures, a lesser penalty for the crime of aggression against women or members of the family group (article 122-B of the Penal Code), in comparison with the crime of resistance or disobedience to authority (article 368 of the Penal Code)? And the objective was: To determine if there is a non-observance of the principle of harmfulness in criminal law when it contemplates, in cases of non-compliance with protection measures, a lesser penalty for the crime of aggression against women or members of the family group (article 122-B of the Penal Code), in comparison with the crime of resistance or disobedience to authority (article 368 of the Penal Code). The population was made up of the fiscal district of Loreto, the sample was made up of 30 criminal prosecutors between Provincials and Provincial Assistants. The design that was used was non-experimental of the transactional-correlational type. For the statistical analysis, descriptive statistics were used, for the study of the variables independently and for the demonstration of the hypotheses, the parametric chi-square test (x2) was used. The results indicated that: There is a non-observance of the principle of harmfulness in criminal law when it contemplates, in cases of non-compliance with protection measures, a lesser penalty for the crime of assaults against women or members of the family group (article 122 -B of the CP), in comparison with the crime of resistance or disobedience to authority (article 368 of the Penal Code), which could weaken the prevention and adequate punishment of crimes of gender violence. Therefore, it is necessary to evaluate the possibility of establishing legislative measures that allow 14 guaranteeing a proportional and effective application, in observance of the principle of harmfulness in the criminal classification of non-compliance with protection measures.
