La resolución de la fiscalía de la nación N° 424-2019-mp-fn y la afectación de la unidad de la investigación en los delitos de corrupción de funcionarios públicos en Loreto durante el periodo 2019-2020

Abstract
La presente investigación versa sobre el análisis de la RESOLUCIÓN DE LA FISCALÍA DE LA NACIÓN N° 424-2019-MP-FN Y LA AFECTACIÓN DE LA UNIDAD DE LA INVESTIGACIÓN EN LOS DELITOS DE CORRUPCIÓN DE FUNCIONARIOS PÚBLICOS EN LORETO DURANTE EL PERIODO 2019-2020, con esta Resolución se dispuso la reasignación de carga procesal en los casos de delitos atribuidos a Magistrados en ejercicio de sus funciones entre la Fiscalía Suprema Transitoria Especializada en Delitos cometidos por Funcionarios Públicos y la Fiscalía Suprema Contencioso Administrativa, invocándose el criterio del grado o jerarquía del Magistrado investigado para efecto de delimitar la competencia entre las mencionadas fiscalías.
Como conclusión se tiene que, la citada Resolución no ha dispuesto reglas en torno a la conexión procesal regulada en el artículo 31° del Código Procesal Penal para efecto que se preserve la unidad de la investigación especializada aun si aparecen involucrados, por ejemplo, Magistrados de diferentes jerarquías, incluso extraneus, que conlleve que una misma fiscalía especializada se ocupe de la respectiva investigación, sin la necesidad de desglosar porque hay Magistrados de instancias diferentes; Además, hemos podido advertir con claridad la no necesidad de desglosar la noticia criminal en diferentes carpetas de investigación, no habría inconveniente alguno que maneje una formalización de la investigación con clasificación jurídica que recurra a algunas de las figuras concursales previstas en el Código Penal.
Por tanto, debe reformarse la mencionada resolución para efecto que se contemple lo señalado y así se fortalezca nuestro sistema especializado de lucha contra la corrupción, evitando investigaciones singulares con pronunciamientos discordantes, así como la afectación de la unidad de la investigación al haberse desconocido la inamovilidad del conocimiento de un asunto en función a las reglas de competencia legal.
The present investigation deals with the analysis of the RESOLUTION OF THE PROSECUTOR'S OFFICE OF THE NATION No. 424-2019-MP-FN AND THE AFFECTATION OF THE INVESTIGATION UNIT IN THE CRIMES OF CORRUPTION OF PUBLIC OFFICIALS IN LORETO DURING THE PERIOD 2019-2020 , with this Resolution, the reassignment of the procedural burden in cases of crimes attributed to Magistrates in the exercise of their functions between the Temporary Supreme Prosecutor's Office Specialized in Crimes committed by Public Officials and the Supreme Contentious-Administrative Prosecutor's Office, invoking the criterion of grade or hierarchy of the Magistrate investigated for the purpose of delimiting the competence between the aforementioned prosecutor's offices. As a conclusion, the aforementioned Resolution has not provided rules regarding the procedural connection regulated in article 31 of the Criminal Procedure Code for the purpose of preserving the unity of the specialized investigation even if they appear involved, for example, Magistrates of different hierarchies, even extraneus, which means that the same specialized prosecutor's office deals with the respective investigation, without the need to break down because there are Magistrates from different instances; In addition, we have been able to clearly see the need to break down the criminal news into different investigation folders, there would be no problem handling a formalization of the investigation with legal classification that resorts to some of the bankruptcy figures provided for in the Penal Code.
