dc.description.abstractThe current research question is: What Constitutional rights can be violated by applying the complete suspension of activities during the state of emergency due to COVID-19? whose general objective is to determine the Constitutional rights violated during the application of the perfect suspension of work during the state of emergency due to COVID-19. Currently, we are dealing with a pandemic that is causing a health and economic crisis. By examining the total suspension of activities and identifying the rights affected by this measure, it is demonstrated that the constitutional right to work is being violated, the right to job continuity is being violated, and the worker's right to receive monetary compensation is being attacked. . Legal dogmatics will be used to determine what has been established in the Constitution, Labor Law, Legislative Decree No. 728, which will become the Labor Productivity and Competitiveness Law, and Emergency Decree No. 038-2020, which establishes complementary measures to reduce the economic effects caused to workers and employers by COVID-19, among other laws.
