Abstract
El presente trabajo de investigación, versa sobre la Casación N°16-2019 Lima Sur, el cual analiza exhaustivamente el desalojo por ocupación precario interpuesto por la Municipalidad Distrital de Pachacamac, del inmueble ubicado frente a la avenida Víctor Malásquez, adyacente al Asentamiento Humano Portada de Manchay – ampliación y la Comunidad Campesina de Collanac, distrito de Pachacamac, provincia y departamento de Lima.
En el presente caso, los ciudadanos Emilia Yauri Carhuas de Rodríguez, Agustina Taype Huamán, Dometila Romero Sanabria y Ana Melva Manuel Romero contestan la demanda negándola en todos tus extremos, en primera instancia el Juzgado Civil Transitorio de Lurín de la Corte Superior de Justicia de Lima Sur declaró fundada la demanda, en razón que la parte demandante acredita ser propietaria del bien inmueble materia de litis.
En segunda Instancia, la Sala Civil de Chorrillos de la Corte Superior de Justicia de Lima Sur, revoca la sentencia de primera instancia y reformándola declara infundada la demanda de desalojo, en razón de que no existe congruencia entre los hechos reales con los fundamentos de la demanda. Posteriormente mediante recurso de casación, la Sala Civil de la Corte Suprema de Justicia de la República lo declara infundado, al no haberse demandado correctamente a todos los posesionarios del bien materia de litis, no ha descrito que extensión ocupan, así como las colindancias y perimétricas del predio, los cuales son determinantes para la individualización del predio atendiendo a su pretensión.
This research paper examines Casación No. 16-2019 Lima Sur, which thoroughly analyzes the eviction for precarious occupation filed by the District Municipality of Pachacamac regarding the property located in front of Víctor Malásquez Avenue, adjacent to the Portada de Manchay Human Settlement – expansion, and the Collanac Peasant Community, in the district of Pachacamac, province and department of Lima. In this case, the citizens Emilia Yauri Carhuas de Rodríguez, Agustina Taype Huamán, Dometila Romero Sanabria, and Ana Melva Manuel Romero responded to the claim by denying it in all respects. In the first instance, the Transitory Civil Court of Lurín of the Superior Court of Justice of Lima Sur ruled in favor of the claim, as the plaintiff demonstrated ownership of the property under litigation. In the second instance, the Civil Chamber of Chorrillos of the Superior Court of Justice of Lima Sur overturned the first-instance ruling and reformed it, declaring the eviction claim unfounded on the grounds that there was no coherence between the real facts and the basis of the claim. Subsequently, through a cassation appeal, the Civil Chamber of the Supreme Court of Justice of the Republic declared it unfounded, as not all occupants of the property under litigation were properly included in the claim, nor was there a description of the area they occupy, as well as the boundaries and perimeter of the property, which are essential for the identification of the property in question.
