Abstract
Los derechos humanos de las mujeres sometidas a agresión sexual
son motivo de preocupación y legislación en varios países. En Perú se
promulgó la Ley N° 32000 con el objetivo de proteger a estas víctimas. Sin
embargo, su implementación ha planteado dudas sobre su eficacia real
para proteger los derechos de las mujeres atacadas.
El principal objetivo de esta investigación fue analizar la conexión
entre la aplicación de la Ley N° 32000 y la posible violación de los derechos
humanos de las mujeres sometidas a agresión sexual en Iquitos en el año
2024. Puede cumplir con su propósito protector o, paradójicamente, estar
vinculada a una mayor vulneración de derechos.
La metodología utilizada fue un enfoque cuantitativo con un diseño no
experimental y un nivel de correlación. Se realizó una encuesta entre 217
abogados registrados en el Colegio de Abogados de Loreto. La herramienta
de recolección de datos fue un cuestionario validado y para el análisis
estadístico se utilizó el coeficiente de correlación de Spearman.
Los resultados mostraron una fuerte correlación positiva (0,843) entre
la aplicación de la Ley N° 32000 y la violación de los derechos humanos de
las mujeres abusadas sexualmente. Particularmente alarmante fue la
correlación aún más fuerte (0,980) entre el procesamiento y la violación del
derecho de las víctimas a la salud física. Estos resultados sugieren que la
implementación de la Ley N° 32000, contrariamente a su intención, puede
estar asociada con un aumento de la violación de los derechos de las
mujeres sometidas a agresión sexual.
The human rights of women subjected to sexual aggression are a matter of concern and legislation in various countries. In Peru, Law No. 32000 was enacted with the aim of protecting these victims. However, its implementation has raised questions about its real effectiveness in safeguarding the rights of women who have been attacked. The main objective of this research was to analyze the connection between the application of Law No. 32000 and the possible violation of human rights of women subjected to sexual aggression in Iquitos in 2024. It sought to determine whether the implementation of this law is fulfilling its protective purpose or, paradoxically, might be linked to a greater violation of rights. The methodology used was a quantitative approach with a nonexperimental design and a correlational level. A survey was conducted among 217 registered lawyers from the Loreto Bar Association. The data collection tool was a validated questionnaire, and Spearman's correlation coefficient was used for statistical analysis. The results showed a strong positive correlation (0.843) between the application of Law No. 32000 and the violation of human rights of sexually abused women. Particularly alarming was the even stronger correlation (0.980) between the processing and the violation of victims' right to physical health. These findings suggest that the implementation of Law No. 32000, contrary to its intention, may be associated with an increase in the violation of rights of women subjected to sexual aggression.
