Abstract

La presente tesis formula la pregunta: ¿Es correcto modificar el artículo 1954 del Código Civil sobre enriquecimiento sin causa para establecer la naturaleza restitutoria del enriquecimiento sin causa?, planteando como objetivo general: Determinar si es correcto modificar el artículo 1954 del Código Civil sobre enriquecimiento sin causa para establecer la naturaleza restitutoria del enriquecimiento sin causa. La metodología que se aplicó es la investigación cuantitativa, de tipo descriptiva y diseño no experimental de corte transversal. Para la presente investigación se aplicó la prueba del Chi cuadrado a fin de obtener la prueba de hipótesis. La población empleada fue el Colegio de Abogados de Loreto y como muestra a 55 abogados litigantes del Colegio de abogados de Loreto. Se obtuvo como resultados que: Sí, es correcto modificar el artículo 1954 del Código Civil para establecer la naturaleza restitutoria del enriquecimiento sin causa. La naturaleza jurídica actual del enriquecimiento sin causa, que es indemnizatoria, no es suficiente para proteger los derechos de la persona que ha sido empobrecida injustamente.

The present thesis asks the question: - Is it correct to modify article 1954 of the Civil Code on enrichment without cause to establish the restitutory nature of enrichment without cause? The methodology applied is quantitative research, descriptive and non-experimental cross-sectional design. For the present research the Chi-square test was applied in order to obtain the hypothesis test. The population used was the Loreto Bar Association and as a sample 55 trial lawyers of the Loreto Bar Association. The results were obtained as follows: Yes, it is correct to modify article 1954 of the Civil Code to establish the restitutory nature of enrichment without cause. The current legal nature of unjust enrichment without cause, which is compensatory, is not sufficient to protect the rights of the person who has been unjustly impoverished.
