Abstract
El objetivo de este estudio comprendió: “Determinar si resultaría eficiente aplicar la prueba trasladada en el proceso penal peruano”.
El estudio empleó un tipo descriptivo. Se siguió un diseño no experimental, en particular caracterizado como descriptivo-transversal.
El Recurso de Nulidad N° 515-2016-Lima, emitido por la Sala Penal Permanente de la Corte Suprema de Justicia de la República del Perú, delimito a la población. La muestra, compuesta por 30 abogados, entre los que había magistrados y litigantes, se seleccionó deliberadamente y no de forma aleatoria.
La recopilación de datos se efectuó mediante de una encuesta, empleando el cuestionario como principal herramienta para recopilar información. Los resultados de este estudio sugieren que aplicar la prueba trasladada e integrarla al proceso penal peruano resultaría eficaz.
The objective of this study has been: to determine whether it would be effective to apply the transferred evidence in the peruvian criminal process. The research was descriptive. The usual design of this work was non-experimental and the design itself was descriptive-cross-sectional. The population was delimited by the Nullity Appeal N° 515-2016Lima, of the Permanent Criminal Chamber of the Supreme Court of Justice of the Republic of Peru. The sample, composed of 30 lawyers, among whom there were judges and litigants, was selected deliberately and not randomly. Data were collected using a survey, with the question questionnaire serving as the data collection tool. According to the effects of this investigation, they indicate that the application of the transferred evidence and its incorporation into the peruvian criminal process would be effective.
