Abstract
El objetivo del presente trabajo fue determinar los fundamentos del
matrimonio en el Perú – 2022, abordando el estudio de tipo básico a
través de un nivel descriptivo, no experimental y transversal, utilizando
el análisis documental para examinar la Sentencia 172/2022, emitida
por el Tribunal Constitucional, en el expediente N° 02743-2021-PA/TC,
que declaró improcedente el recurso de agravio constitucional en la
demanda de amparo de Andree Martinot Serván y Diego Urbina
Fletcher para que puedan inscribir su matrimonio en Reniec,
concluyendo que más allá del sentido de procreación del matrimonio, es
cierto que la unión entre un hombre y una mujer tiene una relación
directa con la subsistencia de la especie, si bien se puede aceptar otro
tipo de uniones, estas no deben tener las características únicas del
matrimonio, que el Tribunal Constitucional ha recogido en la Sentencia
materia de estudio, reconociendo la vigencia y legitimidad del artículo
234 del Código Civil, a pesar de las interpretaciones de diversos
instrumentos internacionales que parecen apuntar hacia la validez del
matrimonio igualitario, pero que en nuestro ordenamiento jurídico no
prevalecen sobre lo que manda la Constitución, y que sirve como
fundamento para la concepción de matrimonio únicamente heterosexual
que tiene nuestro Código Civil.
The objective of this work was to determine the foundations of marriage in Peru - 2022, addressing the basic type study through a descriptive, nonexperimental and cross-sectional level, using documentary analysis to examine Judgment 172/2022, issued by the Constitutional Court, in file No. 02743-2021-PA/TC, which declared the appeal for constitutional grievance inadmissible in the amparo lawsuit filed by Andree Martinot Serván and Diego Urbina Fletcher so that they can register their marriage in Reniec, concluding that beyond From the procreative meaning of marriage, it is true that the union between a man and a woman has a direct relationship with the subsistence of the species, although other types of unions can be accepted, they should not have the unique characteristics of marriage, which The Constitutional Court has included in the Judgment matter of study, recognizing the validity and legitimacy of article 234 of the Civil Code, despite the interpretations of various international instruments that seem to point towards the validity of equal marriage, but that in our legal system do not prevail over what is mandated by the Constitution, and which serves as the foundation for the conception of only heterosexual marriage that our Civil Code has.
