Abstract
El objetivo del estudio fue determinar la relación entre la percepción de la efectividad del sistema de penas y la reincidencia delictiva en la región policial de San Martín Tarapoto, 2023. La metodología fue de tipo básica, en donde se ha considerado un diseño correlacional, aplicando el cuestionario a un total de 75 operadores de justicia expertos en derecho penal. Los resultados indicaron que hubo una relación significativa de valor 0.409 entre la percepción de la efectividad del sistema de penas y la reincidencia delictiva. Se ha concluido que esta relación se confirmó al alcanzar una sigma inferior a 0.050. Un sistema percibido como ineficiente puede debilitar el efecto disuasorio de las penas, facilitando la reincidencia. Esta percepción, influenciada por la experiencia personal y la cobertura mediática, destaca la importancia de abordar la interpretación pública para mejorar la efectividad del sistema penal.
