Abstract
La presente investigación partió del problema ¿La flexibilización sin límites de los principios de congruencia, preclusión y eventualidad procesal en los procesos judiciales de familia puede afectar al derecho al debido proceso? Y el objetivo fue: Determinar si la flexibilización sin límites de los principios de congruencia, preclusión y eventualidad procesal en los procesos judiciales de familia incide en la vulneración al derecho al debido proceso. La técnica que se empleó fue la encuesta y el instrumento fue el cuestionario. La población estuvo conformada por abogados de la Provincia de Maynas del Departamento de Loreto. La muestra incluyó 25 abogados colegiados especializados en Materia Civil y Familia y 5 magistrados entre Jueces y Fiscales Civiles y Familia. El diseño que se empleó fue no experimental de tipo correlacional. El método de investigación fue Científico -Descriptivo – Explicativo. Los resultados indicaron que: La flexibilización sin límites de los principios de congruencia, preclusión y eventualidad procesal en los procesos judiciales de familia incide en la vulneración del derecho al debido proceso.
This investigation started from the problem: Can the unlimited flexibility of the principles of congruence, estoppel and procedural eventuality in family judicial processes affect the right to due process? And the objective was: To determine if the unlimited flexibility of the principles of congruence, estoppel and procedural eventuality in family judicial processes affects the violation of the right to due process. The technique used was the survey and the instrument was the questionnaire. The population was made up of lawyers from the Province of Maynas in the Department of Loreto. The sample included 25 registered lawyers specialized in Civil and Family Matters and 5 magistrates among Judges and Civil and Family Prosecutors. The design used was non-experimental, correlational. The research method was Scientific - Descriptive - Explanatory. The results indicated that: The unlimited flexibility of the principles of congruence, estoppel and procedural eventuality in family judicial processes affects the violation of the right to due process.
