Abstract
El principio de legalidad, también conocido como fundamento, es una idea sencilla, pero
de gran importancia en el ámbito jurídico, ya que busca que el funcionario respete la Constitución
y las diversas leyes para que el administrado encuentre la seguridad que necesita.
Las consecuencias jurídicas del principio de legalidad en el procedimiento administrativo
sancionador del Organismo de Evaluación y Fiscalización Ambiental (OEFA) fueron los que se
buscaron demostrar.
Se tomó al Colegio de Abogados de Loreto (CAL) y seleccionó una muestra de 40
abogados con un margen de error del 5% y un método y diseño explicativo o retrospectivo. El tipo
de investigación fue explicativo, de nivel aplicado.
Para medir las variables, se emplearon la encuesta y el cuestionario; esto le dio validez a
los jueces expertos en el tema que completaron la ficha; además, se procesó estadísticamente
mediante el uso del modelo Chi-Cuadrado.

Por último, el principio de legalidad tiene un impacto significativo en el proceso
administrativo sancionador del Organismo de Evaluación y Fiscalización Ambiental (OEFA).

The legal consequences of the principle of legality in the administrative sanctioning procedure of the Environmental Assessment and Enforcement Agency (OEFA) were what we sought to demonstrate.
