Abstract
La presente investigación partió del problema ¿El artículo 771 º Código Civil
sobre la Cuarta Falcidia, vulnera la voluntad del testador y el derecho de
los herederos, al aplicar la reducción de los bienes? Y el objetivo fue:
Determinar si el artículo 771 º Código Civil sobre la Cuarta Falcidia, vulnera
la voluntad del testador y el derecho de los herederos, al aplicar la
reducción de los bienes. La técnica que se empleó fue la encuesta y el
instrumento fue el cuestionario. La población estuvo conformada por 28
abogados litigantes de la Provincia de Maynas, la muestra estuvo
conformada por 26 abogados litigantes. El diseño que se empleó en la
presente investigación es la "No experimental de tipo transaccional o
transversal de nivel correlaciona!". Para el análisis estadístico se usó la
estadística descriptiva, para el estudio de las variables de manera
independiente y para demostración de las hipótesis se usó la prueba
paramétrica chi cuadrado (x2). Los resultados indicaron que: El artículo
771 º Código Civil sobre la Cuarta Falcidia, sí vulnera la voluntad del
testador y el derecho de los herederos, al aplicar la reducción de los bienes.
Habiendo determinado lo anterior, podemos indicar entonces que resultaría
factible modificar el Artículo 771 º Código Civil sobre la Cuarta Falcidia,
porque vulnera la voluntad del testador y el derecho de los herederos.
The present research was based on the problem: Does article 771 º Civil Code on the Fourth Falcidia, violate the will of the testator and the right of the heirs, when applying the reduction of the assets? And the objective was: To determine whether article 771 º Civil Code on the Fourth Falcidia, violates the will of the testator and the right of the heirs, when applying the reduction of the assets. The technique used was the survey and the instrument was the questionnaire. The population consisted of 28 trial lawyers of the Province of Maynas, the sample consisted of 26 trial lawyers. The design used in this research is the "non-experimental transactional or transversal type of correlational level". For the statistical analysis, descriptive statistics were used to study the variables independently and to demonstrate the hypotheses, the parametric chi-square test (x2) was used. The results indicated that: Article 771 º Civil Code on the Fourth Falcidia, does violate the will of the testator and the right of the heirs, when applying the reduction of assets. Having determined the above, we can then indicate that it would be feasible to amend Article 771 º Civil Code on the Fourth Falcidia, because it violates the will of the testator and the right ofthe heirs.
