Abstract
La presente investigación partió del problema ¿Cuál fue la problemática del
desalojo de alquileres con fines de viviendas en tiempo de pandemia por falta de
pago, Iquitos, Loreto, 2021? Y el objetivo fue: Explicar cuál fue la problemática
del desalojo de alquileres con fines de viviendas en tiempo de pandemia por falta
de pago, Iquitos, Loreto, 2021. La técnica que se empleó fue la encuesta y el
instrumento fue el cuestionario. La población estuvo conformada por 15
abogados litigantes de la Provincia de Maynas, la muestra estuvo conformada
por 14 abogados litigantes. El diseño que se empleó en la presente investigación
es la “No experimental de tipo transaccional o transversal de nivel correlacional”.
Para el análisis estadístico se usó la estadística descriptiva, para el estudio de
las variables de manera independiente y para demostración de las hipótesis se
usó la prueba paramétrica chi cuadrado (x2). Los resultados indicaron que: La
problemática del desalojo de alquileres con fines de viviendas en tiempo de
pandemia por falta de pago, en la Ciudad de Iquitos, Loreto, en el año 2021, fue
el impedimento para salir y la insolvencia económica. Habiendo determinado lo
anterior, podemos indicar entonces que resultaría factible modificar el Artículo
591 del Código Procesal Civil por el siguiente texto “si el desalojo se sustenta en
la causal de falta de pago o vencimiento de plazo, esta es pasible de
otorgamiento de un plazo adicional ante situación de desastre, estos sean
producidos por naturaleza o por intervención de manos humanas, siempre que
se compruebe el estado real de desastre del inquilino moroso”.
The present research was based on the problem: What was the problem of eviction of rentals for housing purposes in times of pandemic due to lack of payment, Iquitos, Loreto, 2021? And the objective was: To explain what was the problem of the eviction of rentals for housing purposes in time of pandemic due to lack of payment, Iquitos, Loreto, 2021. The technique used was the survey and the instrument was the questionnaire. The population consisted of 15 trial lawyers from the Province of Maynas, and the sample consisted of 14 trial lawyers. The design used in this research is the "non-experimental transactional or transversal type of correlational level". For the statistical analysis, descriptive statistics were used to study the variables independently and the parametric chi-square test (x2) was used to demonstrate the hypotheses. The results indicated that: The problem of eviction of rentals for housing purposes in pandemic time due to lack of payment, in the City of Iquitos, Loreto, in the year 2021, was the impediment to leave and economic insolvency. Having determined the above, we can then indicate that it would be feasible to modify Article 591 of the Code of Civil Procedure by the following text "if the eviction is based on the cause of nonpayment or expiration of term, this is subject to the granting of an additional term in case of a disaster situation, whether caused by nature or by human intervention, provided that the real state of disaster of the defaulting tenant is proven".
