Control de la ejecución de sentencias de alimentos y protección del interés superior del niño en maynas, loreto-2023

Abstract

Esta investigación se inició a partir del problema ¿De qué manera la ausencia de un mecanismo de control y seguimiento en la ejecución de las sentencias de alimentos de menores de edad, respecto al uso adecuado de la pensión alimenticia por parte del representante del menor demandante, afecta los principios del interés superior del niño y el derecho fundamental a recibir alimentos en Maynas, Loreto-2023? Y el objetivo fue: De qué manera la ausencia de un mecanismo de control y seguimiento en la ejecución de las sentencias de alimentos de menores de edad, respecto al uso adecuado de la pensión alimenticia por parte del representante del menor demandante, afecta los principios del interés superior del niño y el derecho fundamental a recibir alimentos en Maynas, Loreto-2023. Se aplicaron técnicas como la encuesta e instrumentos como el cuestionario. La población materia de análisis estuvo conformada por Abogados de la Provincia de Maynas del Departamento de Loreto, especializados en Derecho Civil y Familia, Magistrados del Poder Judicial y del Ministerio Público, especializados en Derecho Civil y Familia de la Provincia de Maynas Departamento de Loreto Ciudadanos en la Provincia de Maynas, Departamento de Loreto. La muestra incluyó 15 Abogados de la Provincia de Maynas del Departamento de Loreto, especializados en Derecho Constitucional, Penal y Familia 15 Magistrados del Poder Judicial y del Ministerio Público, especializados en Derecho Constitucional, Penal y Familia de la Provincia de Maynas Departamento de Loreto 30 Ciudadanos en la Provincia de Maynas, Departamento de Loreto. Se utilizó un diseño correlacional no experimental. El método de investigación fue Científico - Descriptivo - Explicativo. Los resultados indicaron que: La ausencia de un mecanismo de control y seguimiento en la ejecución de las sentencias de alimentos de menores de edad, respecto al uso adecuado de la pensión alimenticia por parte del representante del menor demandante, colisiona con los principios del interés superior del niño y el derecho fundamental a recibir alimentos, al no garantizar que los recursos asignados sean utilizados efectivamente para satisfacer las necesidades del menor, generando desprotección y afectando su desarrollo integral en Maynas, Loreto- 2023“This research was initiated based on the problem: In what way does the absence of a control and monitoring mechanism in the execution of child support sentences, regarding the proper use of the child support pension by the representative of the claimant minor, affect the principles of the best interest of the child and the fundamental right to receive child support in Maynas, Loreto- 2023? The population under analysis was made up of Lawyers from the Province of Maynas in the Department of Loreto, specialized in Civil and Family Law, Judges of the Judiciary and the Public Ministry, specialized in Civil and Family Law in the Province of Maynas, Department of Loreto, and Citizens in the Province of Maynas, Department of Loreto. The sample included 15 Lawyers from the Province of Maynas in the Department of Loreto, specialized in Constitutional, Criminal, and Family Law, 15 Judges of the Judiciary and the Public Ministry, specialized in Constitutional, Criminal, and Family Law in the Province of Maynas, Department of Loreto, and 30 Citizens in the Province of Maynas, Department of Loreto. A non-experimental correlational design was used. The research method was Scientific - Descriptive - Explanatory. The results indicated that: The absence of a control and monitoring mechanism in the execution of child support sentences, regarding the proper use of the child support pension by the representative of the claimant minor, collides with the principles of the best interest of the child and the fundamental right to receive child support, as it does not guarantee that the allocated resources are effectively used to meet the needs of the minor, generating a lack of protection and affecting their integral development in Maynas, Loreto-2023.”
