Vulneración de la culpabilidad, fines de la pena e igualdad, por la responsabilidad restringida de agentes de 18 a 21 años, en los procesos penales de maynas, periodo 2018 – 2020

Abstract

El trabajo de investigación tuvo como objetivo determinar si la restricción legal en materia de responsabilidad restringida por la edad de agentes mayores de 18 y menores de 21 años, vulnera la culpabilidad (como elemento de la teoría del delito), los fines de la pena y el derecho a la igualdad; asimismo, comprobar qué fundamentados se adoptaron en los procesos penales de Maynas, en el periodo 2018 – 2020, sobre la prohibición normativa que se encuentra prevista en el segundo párrafo del artículo 22 del Código Penal. La población está conformada por los Jueces Penales de la Corte Superior de Justicia de Loreto, siendo la muestra analizada sentencias condenatorias correspondientes a procesos penales tramitados en el Distrito Judicial de Loreto – Provincia de Maynas, durante el periodo 2018 – 2020. Así también se realizó encuestas a 15 magistrados tanto de la Corte Superior de Justicia de Loreto como del Distrito Fiscal de Loreto, así como a 15 abogados del Distrito Judicial de Loreto, a quienes se formularon preguntas estructuradas relacionadas inexorablemente con el tema materia de estudio. Las técnicas empleadas en la recolección de los datos fueron la documental, mediante la cual se recabó información de las sentencias condenatorias, siendo el instrumento utilizado la ficha de registro; también las encuestas formuladas a magistrados de la Corte Superior de Justicia de Loreto y del Distrito Fiscal de Loreto, como a abogados del Distrito Judicial de Loreto, consistiendo el instrumento utilizado el cuestionario previamente estructurado.

The objective of the research work was to determine if the legal restriction in terms of responsibility restricted by the age of agents over 18 and under 21 years of age, violates guilt (as an element of the theory of the crime), the purposes of the penalty and the right to equality; likewise, verify what grounds were adopted in the criminal proceedings of Maynas, in the period 2018 - 2020, on the normative prohibition that is provided for in the second paragraph of article 22 of the Penal Code. The population is made up of the Criminal Judges of the Superior Court of Justice of Loreto, the analyzed sample being convictions corresponding to criminal proceedings processed in the province of Maynas during the period 2018 - 2020. Thus, surveys were also carried out on 15 magistrates from both the Superior Court of Justice of Loreto and the Loreto Fiscal District, as well as 15 lawyers from the Judicial District of Loreto, who were asked structured questions inexorably related to the subject matter of the study. The techniques used in data collection were documentary, through which information on convictions was collected, the instrument used being the registration form; also the surveys made to magistrates of the Superior Court of Justice of Loreto and the Fiscal District of Loreto, as well as to lawyers of the Judicial District of Loreto, the instrument used consisting of the previously structured questionnaire. For data processing, descriptive statistics were applied with analysis of average frequency and percentage, which will be shown in tables and statistical graphs
