Abstract

En la presente investigación de tesis titulada “Protección del heredero a través de la petición de herencia en la Corte Superior de Justicia de Loreto, sede central”, se desarrollan temas como el derecho sucesorio; así mismo, lo regulado en el artículo 664 del Código Civil sobre la petición de herencia y resoluciones judiciales que aborda la presente investigación con un análisis sobre lo resuelto. En ese contexto, se identifica que el procedimiento actual resulta siendo insuficiente para garantizar la restitución de manera oportuna a los herederos que indebidamente no fueron considerados, debido a la ausencia de mecanismos preventivos y como de sanciones contra comportamientos dolosos. Mediante un enfoque cualitativo, se realizó un análisis sobre la realidad jurisdiccional en magistrados, especialistas judiciales en la sede central de Loreto y abogados especialistas. Siendo que los resultados demuestran la necesidad de implementar requisitos adicionales en el procedimiento de sucesión intestada notarial como de establecer sanciones económicas con la finalidad de evitar la disposición indebida de la masa hereditaria siendo así la modificación de la Ley N° 26662 y del artículo 664° del Código Civil, con la finalidad de garantizar la tutela jurisdiccional efectiva y asegurar a todos los herederos.

In the present thesis research entitled "Heir protection through the inheritance claim in the Superior Court of Justice of Loreto, central headquarters," topics such as inheritance law are developed; likewise, the regulations in article 664 of the Civil Code on the inheritance claim and judicial resolutions addressed by this research with an analysis of the rulings. In this context, it is identified that the current procedure is insufficient to guarantee timely restitution to heirs who were unduly ignored, due to the absence of preventive mechanisms and sanctions against fraudulent behavior. Through a qualitative approach, an analysis was carried out on the jurisdictional reality of magistrates, judicial specialists at the Loreto headquarters, and specialized lawyers. The results demonstrate the need to implement additional requirements in the notarial intestate succession procedure as well as to establish economic sanctions in order to avoid the undue disposal of the hereditary estate, thus modifying Law No. 26662 and Article 664 of the Civil Code, to guarantee effective jurisdictional protection and ensure all heirs.
