La conducción compulsiva y sus implicaciones en el derecho a la libertad de tránsito del investigado, maynas, Loreto, 2023 – 2024

Abstract

El problema de investigación del cual parte la presente es ¿Cómo afecta la conducción compulsiva dictada para recabar la declaración del investigado su derecho a la libertad de tránsito en la Provincia de Maynas, Loreto?, cuyo objetivo es el explicar la afectación de la normativa vigente sobre la conducción compulsiva para la declaración del investigado y su impacto en el derecho a la libertad de tránsito. Para ello se utilizó como metodología un estudio correlacional no experimental con enfoque cuantitativo, utilizando una muestra de 60 abogados especializados en Derecho Procesal Penal y Constitucional de Maynas. Se aplicó una encuesta mediante cuestionario y se realizó un análisis estadístico con chi cuadrada (X²) usando SPSS Statistics 27. Principales Resultados: se demostró una afectación desproporcionada al derecho de libertad de tránsito, con un valor Chi-cuadrado X²c=257,291 (p-valor=0,000). El 85% de los encuestados confirmó la restricción innecesaria de movimiento y el 93.4% sugirió modificar la normativa actual, concluyendo la necesidad de reformar el artículo 66 del Código Procesal Penal para garantizar los derechos fundamentales.

The research problem from which this article is based is: How does compulsive driving dictated to obtain the statement of the investigated affect his right to freedom of transit in the Province of Maynas, Loreto?, whose objective is to explain the impact of the current regulations on compulsive driving for the statement of the investigated and its impact on the right to freedom of transit. To this end, a non-experimental correlational study with a quantitative approach was used as a methodology, using a sample of 60 lawyers specialized in Criminal and Constitutional Procedural Law from Maynas. A questionnaire survey was applied and a statistical analysis was performed with chi-square (X²) using SPSS Statistics 27. Main Results: A disproportionate impact on the right to freedom of movement was demonstrated, with a Chi-square value X²c=257.291 (p-value=0.000). 85% of those surveyed confirmed the unnecessary restriction of movement and 93.4% suggested modifying the current regulations, concluding the need to reform Article 66 of the Code of Criminal Procedure to guarantee fundamental rights.
