Suspensión perfecta de labores y la vulneración a los derechos del trabajador en el marco del decreto de urgencia N° 038-2020 (Emergencia Sanitaria) en la ciudad de Iquitos en el 2020

Abstract
La pregunta actual de la investigación es: ¿Qué derechos Constitucionales pueden ser
violados al aplicar la suspensión completa de actividades durante el estado de emergencia por
COVID-19? que tiene como objetivo general determinar los derechos Constitucionales vulnerados
durante la aplicación de la suspensión perfecta de labores durante el estado de emergencia por
COVID-19. En la actualidad, estamos lidiando con una pandemia que está provocando una crisis
sanitaria y económica. Al examinar la suspensión total de actividades y identificar los derechos
afectados por esta medida, se demuestra que se está violando el derecho constitucional al trabajo,
se está violando el derecho a la continuidad laboral y se está atacando el derecho del trabajador a
recibir una compensación monetaria. Se utilizará la dogmática jurídica para determinar lo que se
ha establecido en la Constitución, el Derecho Laboral, el Decreto Legislativo N° 728, que se
convertirá en la Ley de Productividad y Competitividad Laboral, y el Decreto de Urgencia N° 038-
2020, que establece medidas complementarias para reducir los efectos económicos causados a los
trabajadores y empleadores por el COVID-19, entre otras leyes.
The current research question is: What Constitutional rights can be violated by applying the complete suspension of activities during the state of emergency due to COVID-19? whose general objective is to determine the Constitutional rights violated during the application of the perfect suspension of work during the state of emergency due to COVID-19. Currently, we are dealing with a pandemic that is causing a health and economic crisis. By examining the total suspension of activities and identifying the rights affected by this measure, it is demonstrated that the constitutional right to work is being violated, the right to job continuity is being violated, and the worker's right to receive monetary compensation is being attacked. . Legal dogmatics will be used to determine what has been established in the Constitution, Labor Law, Legislative Decree No. 728, which will become the Labor Productivity and Competitiveness Law, and Emergency Decree No. 038-2020, which establishes complementary measures to reduce the economic effects caused to workers and employers by COVID-19, among other laws.
