Abstract
La investigación titulada “La filiación por voluntad afectiva en parejas no heterosexuales y la vulneración de los derechos fundamentales del niño y el principio de igualdad” planteó como problema general establecer de qué forma la falta de regulación de la filiación sustentada en la voluntad afectiva vulnera los derechos fundamentales del niño y el principio de igualdad dentro del ordenamiento jurídico peruano Su objetivo general consistió en examinar dicha afectación y formular una propuesta de reforma legislativa destinada a posibilitar su reconocimiento jurídico La hipótesis sostuvo que la inexistencia de regulación sobre la filiación por voluntad afectiva ocasiona la vulneración de los derechos fundamentales del niño. El estudio fue de tipo aplicado adoptó un enfoque cuantitativo presentó un nivel explicativo y utilizó un diseño no experimental La población estuvo integrada por abogados especializados en Derecho de Familia considerándose como muestra a los profesionales consultados mediante la técnica de la encuesta y la aplicación de un cuestionario Los resultados obtenidos a través de la prueba de chi-cuadrado permitieron establecer una relación entre las variables analizadas y evidenciaron la necesidad de otorgar reconocimiento jurídico a la filiación socioafectiva Se concluyó que el vacío normativo perjudica derechos como la identidad la igualdad y la protección familiar por lo que se recomendó incorporar el principio de realidad socioafectiva y regular la filiación por voluntad afectiva mediante una modificación del Código Civil peruano.
The research project entitled “Parentage Based on Affective Will in Non-Heterosexual Couples and the Violation of the Fundamental Rights of the Child and the Principle of Equality” posed as its general problem how the lack of regulation of parentage based on affective will violates the fundamental rights of the child and the principle of equality within the Peruvian legal system Its general objective was to examine this impact and formulate a proposal for legislative reform aimed at enabling its legal recognition The hypothesis posited that the absence of regulation on parentage based on affective will leads to the violation of the child's fundamental rights The study was applied in nature adopted a quantitative approach presented an explanatory level and used a non-experimental design The population consisted of lawyers specializing in Family Law and the sample comprised the professionals consulted through a survey and questionnaire The results obtained through the chi-square test established a relationship between the analyzed variables and demonstrated the need to grant legal recognition to socio-affective parentage It was concluded that the current legal gap undermines rights such as identity equality and family protection Therefore it was recommended that the principle of socio-affective reality be incorporated and that parentage based on affective will be regulated through an amendment to the Peruvian Civil Code
