Regulación de la conciliación extrajudicial como requisito de admisibilidad de la demanda contencioso administrativa

Abstract
Los Mecanismos Alternativos de Resolución de Conflictos (MARC) ofrecen vías distintas para solucionar controversias, cuya aplicación resulta cada vez más necesaria en el derecho administrativo. Este estudio propone incluir legislativamente la conciliación extrajudicial como requisito de admisibilidad de la demanda contencioso-administrativa. A través de un análisis documental, se identifican los beneficios de los MARC en el contexto peruano y se evalúa su compatibilidad con la naturaleza de los conflictos administrativos. Los resultados evidencian que regular la conciliación extrajudicial como etapa previa al proceso contencioso-administrativo es jurídicamente viable y responde a criterios de eficacia, política judicial y descongestión del aparato jurisdiccional. Esta medida favorecería la pronta restitución de derechos y promovería una cultura de paz, fortaleciendo la justicia administrativa en beneficio del administrado y de la Administración Pública.
Alternative Dispute Resolution Mechanisms (ADR) offer different ways to resolve disputes, whose use is increasingly necessary in administrative law. This study proposes the legislative inclusion of extrajudicial conciliation as a requirement for the admissibility of administrative litigation claims. Through a documentary analysis, the benefits of ADR in the Peruvian context are identified, and their compatibility with the nature of administrative conflicts is evaluated. The results show that regulating extrajudicial conciliation as a prior stage to the administrative litigation process is legally feasible and responds to criteria of efficiency, judicial policy, and the reduction of judicial congestion. This measure would support the prompt restoration of rights and promote a culture of peace, strengthening administrative justice for the benefit of both the citizen and the Public Administration.
