Relación entre el principio de oportunidad y el derecho del niño alimentista en el distrito judicial de Loreto en 2023

Abstract

El propósito de esta investigación fue establecer si se respeta el Interés Superior del Niño al implementar el Principio de Oportunidad en los Procedimientos por Omisión a la Asistencia Familiar. La metodología utilizada fue la metodología básica, debido a las diversas fuentes de información; se optó por un diseño no experimental con enfoque cuantitativo, orientado a la interpretación de una situación problemática sin la intervención en ella; para la recopilación de datos se utilizó el instrumento conocido como entrevista, a través de la técnica del diálogo; la entrevista se llevó a cabo con abogados expertos en delitos por negligencia familiar, magistrados y personal judicial de la Corte Superior de Justicia de Loreto. El enfoque para el análisis de datos fue el hermenéutico, ya que se llevó a cabo un análisis basándose en los resultados, la teoría y el aspecto jurídico. Los hallazgos logrados establecieron que el Interés Superior del Niño se relaciona con el Principio de Oportunidad en los Procesos por Omisión a la Asistencia Familiar en la ciudad de Iquitos.

The purpose of this investigation was to establish whether the Best Interest of the Child is respected when implementing the Principle of Opportunity in Procedures for Omission of Family Assistance. The methodology used was the basic methodology, due to the various sources of information; A non-experimental design with a quantitative approach was chosen, aimed at the interpretation of a problematic situation without intervention in it; To collect data, the instrument known as an interview was used, through the dialogue technique; The interview was carried out with lawyers who are experts in family negligence crimes, magistrates and judicial personnel of the Superior Court of Justice of Loreto. The approach to data analysis was hermeneutical, since an analysis was carried out based on the results, theory and legal aspect. The findings established that the Best Interest of the Child is related to the Principle of Opportunity in Processes for Omission of Family Assistance in the city of Iquitos.
