Abstract
This thesis focused on determining what are the legal implications of accusation control in the Preparatory Investigation Courts of Maynas, year 2023. During the information gathering phase for the chapters of the theoretical framework, various sources were consulted such as books, legal journals, and national and comparative legislation. Recording and document analysis techniques were used, using specific qualitative research files. Regarding the population and sample, 100 lawyers with experience in Criminal and Procedural law were chosen. Regarding the results: 25% tell us that imprecise and ambiguous facts are sometimes included in the requirements; another 25% that there are incorrect qualifications, of the same photo in percentage that the governing verbs need to be adapted to the fact and finally 25% that there is a lack of motivation in the imputation. Finally, the conclusions show that there are various shortcomings noted within the accusation control hearing, this is due to the insufficient attribution of the fiscal requirements, the necessary defense, and the frustrations of the hearing, among others.
