Abstract

La indagación Eficacia de la tenencia compartida ante desacato y oposición del menor: análisis crítico desde el interés superior del niño, Iquitos 2024 examinó como problema general establecer en qué medida la tenencia compartida resulta efectiva frente al incumplimiento de los progenitores así como ante la oposición del menor en los procesos judiciales mientras que el objetivo general consistió en analizar dicha eficacia considerando la prevalencia del interés superior del niño por consiguiente se planteó como hipótesis específica que ante la oposición del menor el juez prioriza ese principio por encima de la aplicación rigurosa de la tenencia compartida asimismo la investigación correspondió al enfoque cuantitativo además presentó nivel descriptivo y diseño no experimental de carácter transeccional de igual manera la población estuvo integrada por el Colegio de Abogados de Loreto mientras que la muestra quedó conformada por 65 abogados litigantes en ese sentido se empleó la encuesta como técnica y el cuestionario como instrumento de recolección de datos por lo tanto para el contraste de hipótesis se aplicó la prueba de Chi-cuadrado y se obtuvo un valor p < 0.05 lo cual evidenció una relación significativa entre las variables finalmente los resultados demostraron que la tenencia compartida reduce su eficacia en contextos de desacato y oposición del menor a su vez se concluyó que el interés superior del niño prevalece sobre los derechos parentales y por consiguiente se recomendó fortalecer los criterios judiciales así como las evaluaciones interdisciplinaria.

Effectiveness of Joint Custody in the Face of Parental Disobedience and the Child’s Opposition A Critical Analysis from the Perspective of the Best Interests of the Child, Iquitos 2024” addresses the issue of determining to what extent joint custody is effective when there is non-compliance by one of the parents and opposition from the child in judicial proceedings. The general objective was to analyze the effectiveness of joint custody considering the prevalence of the best interests of the child, with the specific hypothesis that, when the child opposes living with one parent, judges prioritize the best interests of the child over the strict application of joint custody. The study followed a quantitative approach, with a descriptive level and a non-experimental, cross-sectional design. The population consisted of members of the Loreto Bar Association, and the sample included 65 practicing lawyers. Data were collected using a survey technique and a questionnaire as the instrument. Hypotheses were tested using the Chi-square test, obtaining a p-value < 0.05, which demonstrated a statistically significant relationship between the variables. The results revealed that joint custody loses effectiveness in cases of parental disobedience and child opposition. It was concluded that the best interests of the child prevail over parental rights, and it was recommended to strengthen judicial criteria and interdisciplinary evaluations in joint custody cases.
