Inclusión del informe y declaración jurada para pensiones de alimentos con montos superiores a 20 unidades de referencia procesal, Iquitos, 2023

Abstract

Esta investigación aborda el problema general si debería incluirse un informe y declaración jurada en las pensiones de alimentos que superen las 20 Unidades de Referencia Procesal (URP) en Iquitos, con el objetivo general de determinar la necesidad de estos documentos para garantizar equidad y transparencia en pensiones elevadas, sustentado en la hipótesis general de que su inclusión es necesaria para proteger los derechos de los hijos y asegurar decisiones judiciales justas. Metodológicamente, el estudio adopta un enfoque cuantitativo, descriptivo y no experimental con diseño transeccional, utilizando como población al Colegio de Abogados de Loreto y una muestra de 45 abogados litigantes seleccionados por muestreo por conveniencia. Se plantea analizar la relación entre la inclusión de los documentos y la equidad en las pensiones, concluyendo que la investigación busca fundamentar la regulación de estos requisitos para pensiones superiores a 20 URP, promoviendo así la transparencia y la protección del interés superior del menor.

This research addresses the general problem of whether a sworn statement and financial report should be required for child support payments exceeding 20 Procedural Reference Units (URP) in Iquitos. The general objective is to determine the necessity of these documents to ensure fairness and transparency in high-value support payments, based on the general hypothesis that their inclusion is essential to protect children's rights and ensure fair judicial decisions. Methodologically, the study adopts a quantitative, descriptive, and nonexperimental approach with a cross-sectional design, using the Loreto Bar Association as the population and a sample of 45 practicing lawyers selected through convenience sampling. The study aims to analyze the relationship between the inclusion of these documents and fairness in support payments, concluding that the research seeks to justify regulating these requirements for payments exceeding 20 URP, thereby promoting transparency and safeguarding the best interests of the child.
