La tutela jurisdiccional efectiva favorece tenencia compartida en el distrito de Iquitos en el año 2023

Abstract

El objeto de estudio de la presente investigación fue analizar de qué manera la tutela jurisdiccional efectiva, puede coadyuvar a la materialización del derecho a la tenencia compartida; bajo un enfoque cuantitativo y de diseño teoría fundamentada, logrando así obtener que la actividad jurisdiccional sea decisiva para la materialización del derecho a la Tenencia Compartida, pues esta garantizará que ambos padres tengan las condiciones ideales para desarrollar la tenencia bajo los cánones de una vida digna. Asimismo, pretende promover el ejercicio del derecho a la paternidad responsable, es decir, el actuar consciente de cada uno de los padres en la educación integral de sus hijos permitirá forjarse un futuro personal, familiar, académico y/o laboral; finalmente, incide en el libre desarrollo de la personalidad y proyecto de vida de cada uno de sus hijos, quienes podrán arribar a sus metas o aspiraciones que fueron proyectadas en beneficio familiar. Y concluyendo que, la tenencia compartida dispuesta por el juez garantiza el derecho al libre desarrollo integral de la personalidad, al permitirle superar las barreras familiares luego de la separación o divorcio que impide dirían alcanzar su pleno potencial.

The objective of this research was to analyze how effective judicial protection can contribute to the realization of the right to shared custody; using a quantitative approach and grounded theory design, thus achieving that judicial activity is decisive for the realization of the right to shared custody, since it will guarantee that both parents have the ideal conditions to develop custody under the canons of a dignified life. It also seeks to promote the exercise of the right to responsible parenthood, that is, the conscious action of each parent in the comprehensive education of their children will allow them to forge a personal, family, academic and/or professional future; finally, it impacts the free development of the personality and life plans of each of their children, who will be able to achieve their goals or aspirations that were projected for the benefit of the family. And concluding, the joint custody ordered by the judge guarantees the right to the free and comprehensive development of personality, allowing the individual to overcome family barriers after separation or divorce that prevent them from reaching their full potential.
