La exoneración de la obligación alimentaria y su impacto en la tutela judicial efectiva del obligado, Maynas, 2024

Abstract

La presente investigación partió del problema ¿ Cuáles son las consecuencias de que la exoneración de la obligación alimentaria surta efectos únicamente a partir de una sentencia judicial firme, cuando el obligado atraviese una reducción significativa de ingresos? el objetivo fue: Determinar de qué manera la exoneración de la obligación alimenticia, que surta efectos desde la sentencia firme, afecta la tutela judicial efectiva y en la subsistencia económica del obligado, que sufre alguna reducción de ingresos que afecta su subsistencia, la técnica que se empleó fue la encuesta y el instrumento fue el cuestionario. La población estuvo conformada por abogados del Colegio de Abogados de Loreto, la muestra fue de 45 abogados, el diseño que se empleó fue no experimental Explicativo, los resultados indicaron que: “se afecta significativamente la tutela judicial efectiva si recién con sentencia firme se exonera de la pensión de alimentos al obligado.This research was based on the problem: What are the consequences of the exemption from the alimony obligation taking effect only from a final court ruling, when the obligated party goes through a significant reduction in income? The objective was: To determine how the exemption from the alimony obligation, which takes effect from the final ruling, affects the effective judicial protection and the economic subsistence of the obligated party, who suffers some reduction in income that affects their subsistence, the technique used was the survey and the instrument was the questionnaire.
