La ausencia de un límite de edad claro y razonable en la función notarial, Iquitos, 2024

Abstract

El presente trabajo de investigación titulado "La ausencia de un límite de edad claro y razonable en la función notarial, Iquitos, 2024” cuenta con la siguiente problemática: ¿Es correcto el límite de edad para ejercer la función notarial, considerando la capacidad física y mental? El objetivo principal del presente es poder determinar la adecuación respecto al límite de edad en la función notarial para así garantizar eficacia y ética. Se considera como hipótesis específica que los notarios mayores de 75 años presentan deterioro cognitivo/físico que pueden afectar su desempeño laboral. Este estudio de investigación es de Tipo cuantitativo y cuenta con un nivel descriptivo y diseño no experimental y transeccional. La población fueron profesionales pertenecientes al Colegio de Abogados de Loreto, y se contó con una muestra de 75 abogados. Se utilizó la encuesta como técnica por medio de un cuestionario validado por expertos y como instrumento, se usó la Prueba de Chi cuadrado. Se rechazó la hipótesis nula (χ²=22.045; p<0.001), respaldando la relación entre edad avanzada y riesgos en la función notarial. Los resultados finales demostraron que la ausencia de un claro límite de edad sí aumenta errores, irregularidades e influencia no debidas en notarios mayores. Como conclusión, se requiere establecer un límite de edad razonable con evaluaciones en capacidad física, mental y actualización jurídica.

This research paper, entitled "The Absence of a Clear and Reasonable Age Limit for Notarial Functions, Iquitos, 2024," addresses the following problem: Is the age limit for practicing as a notary appropriate, considering physical and mental capacity? The main objective is to determine the suitability of the age limit for notarial functions in order to guarantee efficiency and ethical conduct. The specific hypothesis is that notaries over 75 years of age may experience cognitive and/or physical decline that could affect their work performance. This quantitative research study employs a descriptive, non-experimental, and cross-sectional design. The study population consisted of professionals belonging to the Loreto Bar Association, and a sample of 75 lawyers was selected. A survey was used as the data collection technique, employing a questionnaire validated by experts. The Chi-square test was used as the statistical instrument. The null hypothesis was rejected (χ²=22.045; p<0.001), supporting the relationship between advanced age and risks in the notarial function. The final results demonstrated that the absence of a clear age limit does increase errors, irregularities, and undue influence by older notaries. In conclusion, it is necessary to establish a reasonable age limit based on assessments of physical and mental capacity and legal expertise.
