El trabajo infantil y los derechos del niño en la ciudad de Iquitos en el año 2023

Abstract

El propósito principal de esta tesis denominada "Trabajo infantil y derechos del niño en la ciudad de Iquitos en el año 2023" es reconocer las teorías del trabajo infantil y sentar los cimientos de una nueva teoría basada en las interpretaciones al derecho del niño en Iquitos durante el 2023. La metodología se basa en el enfoque cualitativo; el tipo de investigación es básica; el diseño se basa en la teoría fundamentada y la fenomenología; la población comprende a abogados expertos en derecho del niño y los niños, niñas y adolescentes trabajadores; el grupo de estudio incluye a veinticuatro (24) abogados expertos en derecho del niño para la elaboración de teoría fundamentada; el método de investigación empleado fue la entrevista; y, la herramienta empleada es la guía de entrevista. Los hallazgos logrados al finalizar el debate de resultados nos condujeron a reconocer varias teorías sobre el trabajo infantil, basándonos en las interpretaciones al derecho del niño en Iquitos en 2023, Además, una teoría emergente óptima es la que desafía los patrones de la doctrina de la situación irregular y se ajusta a la doctrina de la protección integral de los niños, niñas y adolescentes, con el objetivo de fortalecer su reconocimiento como sujetos de derechos, fundamentado en el interés superior del niño, el derecho a residir en una familia, a un nivel de vida apropiado para su crecimiento y la libertad de manifestar su punto de vista libremente.

The main purpose of this thesis called "Child labor and children's rights in the city of Iquitos in the year 2023" is to recognize the theories of child labor and lay the foundations of a new theory based on the interpretations of children's rights in Iquitos during 2023. The methodology is based on the qualitative approach; the type of research is basic; the design is based on grounded theory and phenomenology; The population includes lawyers who are experts in children's law and working children and adolescents; The study group includes twenty-four (24) lawyers who are experts in children's law for the development of grounded theory; The research method used was the interview; and, the tool used is the interview guide. The findings achieved at the end of the results debate led us to recognize several theories about child labor, based on the interpretations of the right of the child in Iquitos in 2023. Furthermore, an optimal emerging theory is one that challenges the patterns of the doctrine of irregular situation and conforms to the doctrine of the comprehensive protection of children and adolescents, with the aim of strengthening their recognition as subjects of rights, based on the best interests of the child, the right to reside in a family, to a appropriate standard of living for your growth and the freedom to express your point of view freely.
