Abstract
El presente análisis jurídico, es elaborado en base a un importante caso resuelto por la Sala Civil Permanente de la Corta Suprema de Justicia de la República, que mediante la Casación 3974-2018 LAMBAYEQUE se realiza un exhaustivo análisis de la controversia referida a la Ejecución de Garantías Hipotecaria, sobre la vulneración al Debida proceso en el proceso sobre Ejecución de Garantías, en cuánto a que se sostiene que la Resolución de vista adolece de una debida motivación a las resoluciones judiciales y constituye una vulneración al debido proceso en cuanto el Juez como director del proceso debe agotar los medios necesarios a fin de resolver el conflicto de intereses con relevancia jurídica, conforme a los artículos 194º del Código Procesal Civil y el artículo III Título preliminar del Código Procesal Civil, y, por ende, comete presuntamente las infracciones normativas anteriormente mencionadas. Teniendo como antecedentes diversos criterios expresados por la Corte Suprema, asimismo tenemos al VI Pleno Casatoria Civil contenido de la Casación Nº 2402-2012 Lambayeque, en el presente caso ha quedado demostrado que en los supuestos en donde existan medios probatorios insuficientes, es deber del juez agotar los medios necesarios para poder resolver el presente conflicto de intereses, por lo que al examinar el presente caso, se ha visto que el auto de vista vulnera el debido proceso. Este recurso extraordinario de casación tiene como objetivo resolver la controversia, resolviendo la cuestión jurídica objeto de control consistente en determinar si la Casación Nª 3974-2018-LAMBAYAQUE vulnera a la debida motivación e resoluciones judiciales y al debido proceso al pronunciarse y declarar Fundado el recurso de casación que se interpuso contra el auto de vista de fecha 13-06-2018 que confirma la improcedencia de la demanda. Material y Métodos; se empleó una ficha de análisis de documentos, analizando una muestra consistente en la CASACIÓN Nº 3974-2018 LAMBAYAQUE, utilizando el Método tipo de investigación fue Cualitativo, nivel Descriptivo y diseño de no experimental ex post facto. En el Resultado, la Sala Suprema, declara Fundado el recurso casación interpuesto por ALICORP S.A.A., en consecuencia, DISPUSIERON que el Juez de la causa emita nuevo fallo, previo análisis. Asimismo, en el presente caso la resoluci9ón de vista produjo la vulneración al derecho al debido proceso y a la debida motivación de las resoluciones judiciales, y la Sala Civil Permanente de la Corte Suprema de Justicia de la República es quien resuelve y se encarga de motivarla su decisión de manera correcta y conforme la ley.
This legal analysis is based on a significant case resolved by the Permanent Civil Chamber of the Supreme Court of Justice of the Republic, specifically Cassation 3974-2018 LAMBAYEQUE. The Court conducted an exhaustive analysis of the controversy surrounding the Execution of Mortgage Guarantees, focusing on a violation of due process in the Guarantee Execution proceedings. The Court argued that the appellate court's decision lacked proper justification and constituted a violation of due process, as the judge, as the director of the proceedings, was obligated to exhaust all necessary means to resolve the legally relevant conflict of interests, in accordance with Article 194 of the Code of Civil Procedure and Article III of the Preliminary Title of the Code of Civil Procedure, and, therefore, allegedly commits the aforementioned regulatory infractions. Given various precedents expressed by the Supreme Court, as well as the Sixth Civil Plenary Session contained in Cassation No. 2402-2012 Lambayeque, it has been demonstrated in this case that in situations where there is insufficient evidence, it is the judge's duty to exhaust all necessary means to resolve the conflict of interests. Therefore, upon examining this case, it has been observed that the appellate court's decision violates due process. This extraordinary appeal for cassation aims to resolve the controversy by addressing the legal issue under review: whether Cassation No. 3974-2018-LAMBAYAQUE violates the requirement of proper reasoning in judicial decisions and due process by ruling on and declaring the appeal for cassation filed against the appellate court's decision of June 13, 2018, which upheld the dismissal of the claim, to be well-founded. Materials and Methods: A document analysis form was used, analyzing a sample consisting of Cassation No. 3974-2018-LAMBAYAQUE. The research method employed was qualitative, descriptive, and nonexperimental ex post facto. In its findings, the Supreme Court declared the appeal filed by ALICORP S.A.A. well-founded. Consequently, the Court ordered the trial judge to issue a new ruling, following a thorough analysis. Furthermore, in this case, the appellate court's decision violated the right to due process and the requirement for proper justification of judicial decisions.
