La Interveción del Juez de Investigación Preparatoria en la etapa de postulación para colaborador eficaz

Abstract

La presente investigación tuvo como principal fin analizar las deficiencias que aún persisten en la figura procesal de colaborador eficaz, que se encuentra regulado en el Código Procesal Penal - Libro V – Procesos especiales, Sección VI de Proceso por Colaboración Eficaz, desde el Artículo 472° hasta el Art. 481°-A; de modo que, la problemática partió en interrogarnos ¿Qué pasaría si permitimos la intervención del Juez de Investigación Preparatoria – (JIP) en la etapa de postulación para colaborador eficaz? Señalando como objetivo: Plantear los propósitos que cumpliría la intervención del juez de investigación preparatoria en la etapa de postulación para colaborador eficaz; asimismo, establecer de qué forma intervendría, que límites establecería y que cambios presentaría. Empleándose como técnica de recolección de datos, la encuesta y el instrumento fue el cuestionario, con una población conformada por 40 profesionales entre abogados y policías, que desempeñan su labor de forma conjunta en la aplicación de la figura procesal de colaborador eficaz y se estableció como muestra a 36 de los citados. El diseño aplicado en la presente investigación es la “No experimental de tipo transaccional correlacional”. Para el análisis estadístico se usó la estadística descriptiva, para el estudio de las variables de manera independiente y para demostración de las hipótesis se usó la prueba paramétrica Chi Cuadrado (x2). En consecuencia, los resultados indicaron que: Sí resulta probable la intervención del Juez de Investigación Preparatoria – JIP, en la etapa de postulación para colaborador eficaz; ya que, a través de su incorporación permitirá establecer límites para un idóneo proceso de colaboración eficaz y evitar gastos innecesarios en la realización de diligencias dispuestas por el Ministerio Público.

The main purpose of this investigation was to analyze the deficiencies that still persist in the procedural figure of effective collaborator, which is regulated in the Criminal Procedure Code - Book V - Special Processes, Section VI of Process for Effective Collaboration, from Article 472° up to Art. 481°-A; So, the problem began to ask ourselves: What would happen if we allowed the intervention of the Preparatory Investigation Judge - (JIP) in the application stage for an effective collaborator? Pointing out as an objective: To establish the purposes that the intervention of the preparatory investigation judge would fulfill in the application stage for an effective collaborator; likewise, establish how it would intervene, what limits it would establish and what changes it would present. The survey was used as a data collection technique and the instrument was the questionnaire, with a population made up of 40 professionals, including lawyers and police officers, who carry out their work jointly in the application of the procedural figure of effective collaborator and it was established as shows 36 of those mentioned. The design applied in the present investigation is the "Non-experimental transactional-correlational type". For the statistical analysis, descriptive statistics were used, for the study of the variables independently and to demonstrate the hypotheses, the parametric Chi Square test (x2) was used. Consequently, the results indicated that: The intervention of the Preparatory Investigation Judge - JIP is probable, in the application stage for effective collaborator; since, through its incorporation, it will allow the establishment of limits for an ideal process of effective collaboration and avoid unnecessary expenses in carrying out procedures ordered by the Public Ministry.
