El derecho de posesion como mecanismo para adquirir el derecho de propiedad en el distrito de San Juan Bautista en el 2023

Abstract

Este estudio se llevó a cabo con el propósito principal de establecer la influencia del derecho de posesión como medio para obtener el derecho de propiedad en el primer sector del distrito de San Juan Bautista en el año 2023. El método de estudio fue de naturaleza cuantitativa y de diseño no experimental transversal Explicativo; La población estaba compuesta por 200 propietarios del distrito de San Juan Bautista, mientras que la muestra estuvo compuesta por 50 propietarios del mismo distrito. Se utilizó la encuesta como método de recolección de datos y el instrumento utilizado fue el cuestionario. Se determinó una relación moderadamente positiva (Rho=0,425), lo que señala una correlación directa entre el derecho de tenencia y el derecho de propiedad, con una relevancia de p=0,002<0.05. Por lo tanto, se aceptó la hipótesis general, mientras que se descartó la hipótesis nula. Como consecuencia, se determinó que el derecho de posesión, como mecanismo, tiene un impacto considerable en la adquisición del derecho de propiedad en el distrito de San Juan. Basándonos en estos hallazgos, se deduce que los residentes conservan una posesión cualificada haciendo uso y disfrute de su propiedad de forma pacífica, pública y constante durante más de 10 años, y de manera de propietarios, explotan el bien y cumplen con los requisitos establecidos. 12 Se les aconseja utilizar el procedimiento de adquisición de dominio para conseguir un veredicto declarativo de su derecho de propiedad, de esta manera pueden registrar su título en el registro y obtener la protección legal de sus bienes inmuebles.

This study was carried out with the main purpose of establishing the influence of the right of possession as a means to obtain the right of property in the first sector of the district of San Juan Bautista in the year 2023. The study method was quantitative in nature and of a non-experimental cross-sectional Explanatory design; The population was made up of 200 owners from the San Juan Bautista district, while the sample was made up of 50 owners from the same district. The survey was used as a data collection method and the instrument used was the questionnaire. A moderately positive relationship was determined (Rho=0.425), which indicates a direct correlation between the right to tenure and the right to property, with a relevance of p=0.002<0.05. Therefore, the general hypothesis was accepted, while the null hypothesis was discarded. As a consequence, it was determined that the right of possession, as a mechanism, has a considerable impact on the acquisition of property rights in the district of San Juan. Based on these findings, it is deduced that residents retain qualified possession by using and enjoying their property in a peaceful, public and constant manner for more than 10 years, and as owners, they exploit the property and comply with the established requirements. 14 They are advised to use the domain acquisition procedure to obtain a declaratory verdict of their property rights, in this way they can register their title in the registry and obtain legal protection of their real estate.
