Abstract
En esta investigación de tesis titulada “Acreedor alimentario en el procedimiento de liquidación de pensiones devengadas, Juzgado de Paz Letrado de Punchana, Distrito Judicial de Loreto, 2022” desarrolla temas relacionados en materia de alimentos y en especial al procedimiento de liquidación de pensiones devengadas regulado en el artículo 568° del Código Procesal Civil, siendo así necesario entender el procedimiento y de acuerdo con la información brindada por la Corte Superior de Justicia de Loreto se pudo determinar que existe falencias en el procedimiento, por causa de falta de personal originando un incremento de la carga procesal, siendo así una demora de más de un año; con la información adquirida podemos plantear mecanismos de solución de reducción de actos procesales, teniendo en cuenta que al terminar el procedimiento de liquidación de pensiones devengadas en su gran mayoría será enviado al Ministerio Público por delito de omisión a la asistencia familiar, esto causa un gran perjuicio al acreedor alimentario.
In this thesis entitled “Maintenance Creditor in the Procedure for Liquidation of Accrued Pensions, Justice of the Peace Court of Punchana, Judicial District of Loreto, 2022,” it explores topics related to maintenance matters and, in particular, the procedure for the liquidation of accrued pensions regulated by Article 568 of the Civil Procedure Code. It is therefore necessary to understand the procedure and, according to information provided by the Superior Court of Justice of Loreto, it was found that there are deficiencies in the process due to staff shortages, resulting in an increased caseload and a delay of more than one year. With the information obtained, we can propose mechanisms to reduce procedural steps, bearing in mind that upon completion of the liquidation procedure for accrued pensions, in the vast majority of cases the matter will be referred to the Public Prosecutor’s Office for the offence of failure to provide family support, which causes significant prejudice to the maintenance creditor.
