Abstract
Las proposiciones formuladas, han sido evaluadas por una muestra
representativa de efectivos policiales, cuyos resultados a la problemática
planteada: ¿De qué manera las investigaciones preliminares a cargo de la
Policía Nacional, conllevan con el objetivo trazado y dispuesto por el Fiscal
responsable del caso? De lo recabado no ocurre así, esto significa que las
investigaciones preliminares en sede policial a pesar de contar con una
disposición fiscal en la que se ordena la actuación de diversas diligencias,
muchas de ellas se reprograman por la desidia de comparecer de los testigos,
otro, por la no presencia física y oportuna del representante del Ministerio
Público -fiscal- entre otros, conllevando con ello dilaciones en las diligencias
programadas y volviéndose a reprogramar las mismas, y encima el plazo dado
por el Fiscal, ya está vencido o está por vencerse.
La principal metodología fueron la observación sistemática de hechos
ocurridos en las Comisarías, tomadas del cuestionario planteado a policías,
corroboradas por la muestra estudiada, de lo que, al contradecir la hipótesis
alternativa, automáticamente queda aceptada la hipótesis principal, de igual
sus auxiliares, visualizados en el cuadro general Nº 01 y ss del acápite 4.2 de
esta tesis.
The propositions formulated have been evaluated by a representative sample of police officers, the results of which address the problem raised: In what way do the preliminary investigations carried out by the National Police lead to the objective set and established by the Prosecutor responsible for the case? From what was gathered, this does not happen, this means that the preliminary investigations at police headquarters despite having a fiscal provision in which the performance of various procedures is ordered, many of them are rescheduled due to the lack of attendance of witnesses, another , due to the non-physical and timely presence of the representative of the Public Ministry -prosecutor- among others, leading to delays in the scheduled procedures and rescheduling them again, and on top of that the deadline given by the Prosecutor has already expired or is about to expire. . The main methodology was the systematic observation of events that occurred in the Police Stations, taken from the questionnaire posed to police officers, corroborated by the sample studied, so that by contradicting the alternative hypothesis, the main hypothesis is automatically accepted, as well as its auxiliaries, displayed in the general table No. 01 et seq. of section 4.2 of this thesis.
