Validez a los límites al derecho de libre desarrollo de la personalidad en la escuela militar de Chorrillos. 2018 STC. n.° 02098-2010- PA/TC

Abstract

El presente trabajo de investigación tiene por objeto estudiar la figura del libre desarrollo de la personalidad que se analizó en la Sentencia emitida por el Tribunal Constitucional peruano en el expediente 2098-2010 PA/TC, caso mediante el cual se advirtió por parte del máximo órgano de control de la constitucionalidad su vulneración respeto de una alumna de la escuela Militar de Chorrillos. De allí, poder advertir si resulta valido establecer límites a la personalidad y si la fijación de los mismos es estas escuelas castrenses vulneran derechos constitucionales como la autonomía y dignidad humana. En tal sentido, la discusión se centra en establecer si estas instituciones pueden limitar algún derecho dentro de su ámbito de desarrollo y si el Tribunal Constitucional se excedió al amparar la demanda interpuesta.

The purpose of this research work is to study the figure of the free development of personality that was analyzed in the Judgment issued by the Peruvian Constitutional Court in file 2098-2010 PA/TC, a case through which the highest body warned of control of constitutionality its violation respect of a student of the Military School of Chorrillos. From there, to be able to warn if it is valid to establish limits to the personality and if the fixation of the same is these military schools violate constitutional rights such as autonomy and human dignity. In this sense, the discussion focuses on establishing whether these institutions can limit any right within their scope of development and whether the Constitutional Court exceeded itself by supporting the lawsuit filed.
