Abstract

This research, entitled “Access to Civil Justice and Its Contradiction with Procedural Costs in Peru, 2024,” aimed to determine the extent to which procedural costs affect the effective exercise of the constitutional right of access to civil justice in Peru. The general objective was to determine the impact of court fees, notification expenses, and other procedural costs on effective access to civil justice. The general hypothesis stated that procedural costs significantly restrict access to justice, limiting the effective exercise of judicial protection and creating a contradiction with the constitutional principle of free access to justice. The study followed a quantitative approach with a descriptive-correlational level and a nonexperimental, cross-sectional research design. The population consisted of members of the Loreto Bar Association, and the sample included 80 practicing lawyers. Data were collected through a survey using a structured questionnaire. The Chi-square test produced a significance value of p = 0.001, leading to the acceptance of the alternative hypothesis. The findings showed that procedural costs constitute an economic barrier to equal access to civil justice. Consequently, the study recommends a legislative reform establishing a special system for the exemption of procedural costs for economically vulnerable individuals.
