Abstract
El presente trabajo de investigación viene motivado por el análisis de la Casación
N°760-2016-La Libertad emitido por la Sala Penal Permanente de la Corte
Suprema de Justicia de la República, cuyo enfoque de estudio reposa sobre su
primer motivo casacional referido a la naturaleza jurídica de los elementos de
convicción y su suficiencia en la acusación, donde se determina la doctrina
jurisprudencial de la temática referida.
Partiendo de la problemática ¿Cuál es la naturaleza jurídica de la suficiencia de
los elementos de convicción en la etapa intermedia dentro del proceso penal?;
siendo que, esta investigación tiene como objetivo principal; explicar la
naturaleza jurídica de los elementos de convicción en la etapa intermedio dentro
del proceso penal. En relación a los materiales y métodos de investigación,
se empleó el fichaje para el análisis de los documentos; teniendo en cuenta que
la presente investigación es un trabajo de suficiencia profesional está
desarrollada dentro de un enfoque cualitativo de tipo socio jurídico, en la que el
nivel de investigación es de tipo descriptiva.
Asimismo, se obtuvo como resultado que; los elementos de convicción importan
fundamentos o razones suficientes que sustentan la imputación penal sobre la
autoría o participación de un acusado a efectos de determinar si se merece
continuar con el proceso penal, es decir, si hay mérito pasar a la etapa del juicio
oral; de ello, se concluye, también, el grado de convicción que se exige para
formular requerimiento acusatorio es la plena certeza que recae sobre el fiscal
como titular de la acción penal, sobre la autoría del encausado y la comisión del
delito imputado, caso contrario, la insuficiencia de convicción devendrá en un
sobreseimiento.
This research work is motivated by the análisis of Cassation No. 760-2016-La Libertad issued by the Permanent Criminal Chamber oh the Supreme Court of Justice of the Republic, whose study focus rests on its firt cassation reason referred to the legal nature of the elements of conviction and their sufficiency in the accusation, where the jurisprudential doctrine of the referred subject is determined. Starting from the problem, what is the legal nature of the elements of conviction in the intermediate stage within the criminal process?; Being that, this research has as its main objective; explain the legal nature of the elements of convition in the intermediate stage within the criminal process. In relation to the materials and research methods, the filing was used for the analysis of the documents; Taking into account that the present investigation is a work of professional sufficiency, it is developet within a qualitative approach of a socio-legal type, in which the leve lof investigation is descriptive. Likewise, it was obtained as a result that; the elements of conviction matter sufficient grounds or reasons to support the criminal accusation of authorship or participation of a defendant to determine if it is worth continuing with the criminal process, that is, if there is merit to proceed to the oral trial stage; From this, it is also concluded that the degree of conviction required to formulate an accusatory request is the full certainty that falls on the prosecutor as the holder of the criminal action, on the authorship of the accused and the commission of the accused crime, otherwise, the Insufficient sentence will lead to dismissal.
