Abstract
La tesis partió del problema general: ¿Se cumple a cabalidad con el pago de las costas y costos procesales que fueron solicitados por la parte vencedora en los procesos civiles? Planteando así el objetivo general: Determinar si se cumple a cabalidad con el pago de las costas procesales que fueron solicitados por la parte vencedora en los procesos civiles. Esta investigación es de enfoque cuantitativo, no experimental, descriptivo y de corte transversal, constituida por la población de los abogados litigantes del Colegio de Abogados de Loreto, y de muestra a 55 abogados. Se sometió las hipótesis a la Prueba de Chi cuadrado. Se realizó la discusión de resultados y se presentó los resultados aplicándose una encuesta a los 55 abogados litigantes. La investigación sobre el cumplimiento del pago de costas y costos en los procesos civiles en la Corte Superior de Justicia de Loreto, Iquitos, reveló que la legislación actual sobre el tema es insuficiente y genera incertidumbre y conflictos entre las partes involucradas.
This thesis started with the general problem: Is the payment of procedural costs and expenses that were requested by the winning party in civil proceedings fully complied with? Thus, the general objective was: To determine if the payment of procedural costs that were requested by the winning party in civil proceedings is fully complied with. This research is quantitative, non-experimental, descriptive, and cross-sectional, consisting of the population of litigating lawyers from the Loreto Bar Association, and a sample of 55 lawyers. The hypotheses were tested using the Chi-square test. The discussion of results was carried out, and the results were presented by applying a survey to the 55 litigating lawyers. The research on the compliance with the payment of costs and expenses in civil proceedings in the Superior Court of Justice of Loreto, Iquitos, revealed that the current legislation on the subject is insufficient and generates uncertainty and conflicts between the parties involved.
