Abstract
El presente trabajo analiza CASACIÓN N° 676-2019- Lima, expedida por La Sala Civil Permanente de la Corte Suprema de Justicia de la República, respecto a la fijación de criterios para determinar al cónyuge más perjudicado en la separación de hecho, entre las partes don Víctor Mendoza Macassi y doña Julia Valentina Huamán de Mendoza. Por lo que dicho trabajo tiene como objetivo explicar los principios y/o criterios utilizados para determinar cuál de los cónyuges es más perjudicado en una separación de hecho. Planteando como Material y Método, la Casación CASACIÓN N° 676-2019- Lima sentencia dictada por La Sala Civil Permanente de la Corte Suprema de Justicia de la República, utilizando el método Descriptivo no experimental para el presente trabajo. De acuerdo a ello el Resultado A partir de la información obtenida, se puede concluir que, en el contexto de la fijación de una indemnización, es fundamental considerar el daño moral que ha sufrido el cónyuge más perjudicado y su situación económica. Esto se evidencia en el caso de la CASACIÓN N° 676-2019, donde se pone de manifiesto la desventaja económica evidente que enfrenta el cónyuge perjudicado.
Además, en lo que respecta a la separación de hecho, se ha observado que esta ha sido debidamente justificada, ya que la relación de hecho ha sido establecida conforme a la actividad probatoria realizada durante el proceso. Por otro lado, los resultados de las encuestas llevadas a cabo en el marco de esta investigación indican que los criterios utilizados para determinar quién es el cónyuge más perjudicado en una separación de hecho incluyen, de manera primordial, el estado económico del cónyuge y la afectación psicológica que este ha sufrido como consecuencia de la ruptura. Estos elementos son cruciales para una adecuada evaluación de la situación y para garantizar que se otorgue la indemnización justa y proporcional a los daños experimentados.
This work analyzes CASSATION N° 676-2019- Lima, issued by the Permanent Civil Chamber of the Supreme Court of Justice of the Republic, regarding the establishment of criteria to determine the most harmed spouse in the de facto separation, between the parties Mr. Víctor Mendoza Macassi and Mrs. Julia Valentina Huamán de Mendoza. Therefore, the objective of this work is to explain the principles and / or criteria used to determine which of the spouses is most harmed in a de facto separation. Presenting as Material and Method, the Cassation CASSATION N° 676-2019- Lima judgment issued by the Permanent Civil Chamber of the Supreme Court of Justice of the Republic, using the non-experimental Descriptive method for the present work. According to this, the Result From the information obtained, it can be concluded that, in the context of setting compensation, it is essential to consider the moral damage suffered by the most harmed spouse and his or her economic situation. This is evident in the case of CASSATION N° 676-2019, where the obvious economic disadvantage faced by the affected spouse is revealed. Furthermore, with regard to the separation of fact, it has been observed that this has been duly justified, since the de facto relationship has been established in accordance with the evidentiary activity carried out during the process. On the other hand, the results of the surveys carried out within the framework of this investigation indicate that the criteria used to determine who is the most affected spouse in a separation of fact include, in a primary manner, the economic status of the spouse and the psychological affectation that he or she has suffered as a consequence of the breakup. These elements are crucial for an adequate evaluation of the situation and to guarantee that fair and proportional compensation is granted for the damages experienced.
