La inclusión de los hijos de las familias ensambladas a la masa hereditaria en el código civil, Iquitos, 2023

Abstract

En la investigación se utilizó un diseño no experimental de tipo transversal o descriptivo. Para el análisis estadístico se utilizaron métodos descriptivos, para el estudio de las variables de manera independiente se utilizó la prueba paramétrica chi cuadrado (x2). Para ello, se realizó una encuesta a 88 abogados litigantes del Colegio de Abogados de Loreto. Los resultados de la encuesta sugieren que los hijos de las familias ensambladas podrían tener derecho a heredar de sus padres, incluso si estos no son sus padres biológicos. Los resultados se justifican por el interés superior del niño, que debe ser protegido por el Estado. Las familias ensambladas son una realidad cada vez más común, y los hijos que integran estas familias deben tener los mismos derechos que los hijos de familias tradicionales. En ese sentido, se plantea que se debe incorporar un nuevo artículo en el Código Civil que reconozca a las familias ensambladas y establezca sus derechos y protecciones legales.

This thesis is titled: “THE INCLUSION OF THE CHILDREN OF JOINED FAMILIES TO THE HEREDITARY MASS IN THE CIVIL CODE, IQUITOS, 2023” and its purpose is to analyze whether the children of blended families have the right to inherit from their parents. That is why we ask ourselves the following question: Do the children of blended families have the right to be part of the parents' estate? The research used a non-experimental cross-sectional or descriptive design. For the statistical analysis, descriptive methods were used; to study the variables independently, the parametric chi-square test (x2) was used. To do this, a survey was conducted among 88 trial lawyers from the Loreto Bar Association. The survey results suggest that children in stepfamilies may have the right to inherit from their parents, even if their parents are not their biological parents. The results are justified by the best interests of the child, which must be protected by the State. Blended families are an increasingly common reality, and the children who make up these families must have the same rights as the children of traditional families. In this sense, it is proposed that a new article should be incorporated into the Civil Code that recognizes stepfamilies and establishes their legal rights and protections.
