La indebida incorporación oficiosa de terceros al proceso civil vulnera el debido proceso- corte superior de justicia de loreto 2019

Abstract

La presente investigación tiene como objetivo explicar cuáles son los terceros que al incorporarse oficiosamente al proceso civil vulneran el debido proceso en la Corte Superior de Justicia de Loreto 2019. El tipo de investigación es no experimental de tipo correlacional transversal mediante dos variables, una dependiente y otra dependiente. La población está conformada por 83 Abogados Litigantes con casos concurrentes en el Primer y Segundo Juzgado Civil de Maynas y la muestra fue 68 Abogados Litigantes con casos concurrentes en el Primer y Segundo Juzgado Civil de Maynas de la Corte Superior de Justicia de Loreto. La técnica empleada en la recolección de los datos se realizó a través de las entrevistas, las encuestas y el instrumento utilizado fue le cuestionario. En cuanto al análisis estadístico se usó la estadística descriptiva para el estudio de las variables en forma independiente y para demostración de hipótesis se usó la estadística inferencial no paramétrica chi cuadrado (x2), cuya presentación se hizo mediante tablas y gráficos estadísticos. Los resultados revelaron que los terceros que al incorporarse oficiosamente al proceso civil vulnera el debido proceso en la Corte Superior de Justicia de Loreto 2019 son el litisconsorte facultativo y el tercero coadyuvante.

The type of research is non-experimental of a cross-sectional correlational type using two variables, one dependent and the other independent. The population is made up of 83 trial lawyers with concurrent cases in the First and Second Civil Court of Maynas and the sample was 68 trial lawyers with concurrent cases in the First and Second Civil Court of Maynas of the Court Superior of Justice of Loreto. The technique used in data collection was carried out through interviews, surveys and the instrument used was the questionnaire. Regarding the statistical analysis, descriptive statistics were used to study the variables independently and to demonstrate the hypotheses, the non-parametric chi-square (x2) inferential statistics were used, whose presentation was made by means of statistical tables and graphs. The results revealed that the third parties that, by unofficially joining the civil process, violate due process in the Superior Court of Justice of Loreto 2019 are the facultative counsel and the third intervener.
