Abstract
En el contexto del proceso penal peruano inicial, las “salidas alternativas” al proceso penal se refieren a mecanismos que permiten resolver conflictos penales de manera diferente a la tradicional vía del juicio y la sentencia. Estas alternativas buscan soluciones más rápidas, eficientes y a veces más justas, considerando la reparación del daño a la víctima y evitando la saturación del sistema judicial.
Las Salidas Alternativas: Son mecanismos que evitan el juicio oral, ya sea abreviando etapas o terminando el proceso antes de llegar a juicio, buscando una solución más ágil del conflicto mediante:El Principio de Oportunidad, Los Acuerdos Reparatorios o la Terminación Anticipada.
El Nuevo Código Procesal Penal (NCPP) ha introducido cambios significativos en el sistema penal peruano, incluyendo la implementación de salidas alternativas y mecanismos de simplificación procesal. Estas innovaciones buscan : Desjudicialización, Celeridad y eficiencia, Reparación de la víctima, Oralidad y transparencia y Separación de roles.
En resumen, las salidas alternativas en el proceso penal peruano, impulsadas por el NCPP, representan una evolución hacia un sistema más justo, eficiente y que prioriza la reparación de las víctimas, además de buscar soluciones diferentes a la vía tradicional del juicio.
In the context of the initial Peruvian criminal process, "alternative solutions" to the criminal process refer to mechanisms that allow criminal disputes to be resolved differently than the traditional trial and sentencing process. These alternatives seek faster, more efficient, and sometimes fairer solutions, considering reparation for the victim's harm and avoiding overloading the judicial system. Alternative Solutions: These are mechanisms that avoid oral proceedings, either by shortening stages or ending the process before reaching trial, seeking a more agile resolution to the conflict through: the Principle of Opportunity, Reparatory Agreements, or Early Termination. The New Code of Criminal Procedure (NCPP) has introduced significant changes to the Peruvian criminal system, including the implementation of alternative solutions and procedural simplification mechanisms.These innovations seek: Dejudicialization, Speed and Efficiency, Victim Reparations, Orality and Transparency, and Separation of Roles. In short, the alternative options in the Peruvian criminal process, promoted by the NCPP, represent an evolution toward a more just and efficient system that prioritizes reparations for victims, in addition to seeking solutions other than the traditional trial process.
